Book excerpt: Stateless children are born into a world in which they will face a lifetime of discrimination; their status profoundly affects their ability to learn and grow, and to fulfil their ambitions and dreams for the future. With a stateless child being born somewhere in the world at least every 10 minutes, this is a problem that is growing. The effects of being born stateless are severe. This report aims to go beyond these statistics, providing direct testimony of children and young people and how being stateless affects them. In July and August 2015, UNHCR spoke with more than 250 children and youth, and their parents and guardians, in seven countries around the world about their experiences of childhood statelessness. This is the first geographically diverse survey of the views of stateless children and youth. The report highlights how not being recognized as a national of any country can create insurmountable barriers to education and adequate health care and stifle job prospects. It reveals the devastating psychological toll of statelessness and its serious ramifications not only for young people, whose whole futures are before them, but also for their families, communities and countries. It powerfully demonstrates the urgency of ending and preventing childhood statelessness.

Book excerpt: Displaced children often face educational disadvantages in their host countries. Statelessness might be one of the factors limiting educational access, but research on this aspect is limited. In this paper, I leverage the introduction of birthright citizenship for Venezuelan children in Colombia to analyze the effect of ending statelessness on educational participation during early childhood. I employ a difference-in-discontinuity strategy that exploits a birthdate and policy cutoff to determine whether a Venezuelan child became eligible for birthright citizenship or not. I find that the reform has positive effects on the participation rates of children below six years old. I explain these results by demand- and supply-side factors faced by displaced parents and their children.

Book excerpt: This is the first book dedicated to clarifying the concept of “foundlings” and how to best prevent their statelessness in light of the object and purpose of Article 2 of the 1961 UN Convention on the Reduction of Statelessness and equivalent nationality law provisions. Among other features, the book defines the terms “foundling,” including the maximum age limit of the child to be considered a “foundling”; “unknown parents”; being “found” in a territory; and “proof to the contrary”; as well as the procedural issues such as the appropriate burden and standard of proof. In doing so, the book draws upon a comparative analysis of national legislation on “foundlings” covering 193 states, case law, and precedents in some states as well as international human rights law norms including the best interests of the child. As its conclusion, the book proposes an inclusive model “foundling provision” and a commentary to inform legislative efforts and interpretation of the existing provisions. Its findings are useful not only to state parties to the 1961 Convention but also to non-state parties, particularly in countries lacking systematic civil documentation or experiencing the effects of armed conflicts, migration, trafficking, and displacement.

Much recent literature on the subject of statelessness has been written from a US/European perspective. This work addresses this imbalance with an in-depth study of statelessness and best practice in how to prevent it in an African country. The book appraises international legal regimes on statelessness, their efficacy or otherwise in practice, what can be improved under international law, and the relevance of these regimes in the Nigerian context. The regional frameworks include those of the African Union, the Council of Europe, the EU, the Organization of American States, and the Arab League. Comparisons are also drawn with specific countries that already have an enshrined Statelessness Determination Procedure including Ivory Coast, the UK, France, Moldova, and the Netherlands, which does not have a formal procedure but has alternative means of identification. The book assesses the successes and challenges faced in these countries, and evaluates the chances for legal transplantation in Nigeria.
