Updated as of May 29, 2018 We, the National Marine Fisheries Service (NMFS), issue a final rule to revise the current critical habitat for the northern right whale (Eubalaena glacialis) by designating additional areas within the North Pacific Ocean. Two specific areas are designated, one in the Gulf of Alaska and another in the Bering Sea, comprising a total of approximately 95,200 square kilometers (36,750 square miles) of marine habitat. As described in the impacts analysis prepared for this action, we considered the economic impacts, impacts to national security, and other relevant impacts and concluded that the benefits of exclusion of any area from the critical habitat designation do not outweigh the benefits of inclusion. As a result, we did not exclude any areas from the designation. We solicited information and comments from the public in a proposed rule. This final rule is being issued to meet the deadline established in a remand order of the United States District Court for the Northern District of California. In developing this final rule we considered public and peer review comments, as well as economic impacts and impacts to national security. We have decided in the final rule to exclude the Port of Anchorage (POA) in consideration of national security interest. Additionally, consistent with the proposed rule, portions of military lands were determined to be ineligible for designation as critical habitat. We solicited comments from the public on all aspects of the proposed rule, and conducted four public hearings on the action. Along with the proposed rule, we published a draft economic impacts analysis, entitled "Draft RIR/4(b)(2) Preparatory Assessment/IFRA for the Critical Habitat Designation of Cook Inlet Beluga Whale." This economic analysis has been completed to support the final designation. Book excerpt: "A habitat analysis was conducted to examine the relationships between environmental characteristics and the spatial distribution of calving right whales in the southeast United States off of northern Florida and Georgia. A time series of right whale sightings data from aerial surveys conducted between December and March from 1992/1993 to 2000/2001 was used to assess habitat correlations and spatial patterns in right whale distribution. Satellite derived sea surface temperature, bathymetry, modeled average wind data, and several spatial variables were examined using a Generalized Additive Modeling approach. The model results indicate that sea surface temperature and water depth are significant predictors of calving right whale spatial distribution. The habitat relationships are unimodal, with peak sighting rates occurring at water temperatures from 13-15°C and water depths from 10-20m. These habitat features may be used to describe critical habitat areas off the coast of Florida and Georgia. The model also predicts that areas outside of the currently defined critical habitat are important for calving right whales. Recent surveys indicate that waters off of South Carolina and North Carolina are also frequently be used by calving right whales, and the habitat features identified in the current analysis are also present in these regions. However, additional data collection and analysis is needed before applying the predictions of the current model to these areas. The current analysis is developed as a tool for managers to define the spatial extent of right whale calving habitat and to designate revised critical habitat areas as defined by the Endangered Species Act"--Executive summary.

Updated as of May 29, 2018 We, the National Marine Fisheries Service (NMFS), establish regulations under the Endangered Species Act (ESA) and Marine Mammal Protection Act (MMPA) to prohibit vessels from approaching killer whales within 200 yards (182.9 m) and from parking in the path of whales when in inland waters of Washington State. Certain vessels are exempt from the prohibitions. The purpose of this final rule is to protect killer whales from interference and noise associated with vessels. We identified disturbance and sound associated with vessels as a potential contributing factor in the recent decline of this population during the development of the final rule announcing the endangered listing of Southern Resident killer whales and the associated Recovery Plan for Southern Resident killer whales (Recovery Plan). The Recovery Plan calls for evaluating current guidelines and assessing the need for regulations and/or protected areas. To implement the actions in the Recovery Plan, we developed this final rule after considering comments submitted in response to an Advance Notice of Proposed Rulemaking (ANPR) and proposed rule, and preparing an environmental assessment (EA). This final rule does not include a seasonal no-go zone for vessels along the west side of San Juan Island that was in the proposed rule. We will continue to collect information on a no-go zone for consideration in a future rulemaking.
