Book The Oxford Handbook of International Law in Asia and the Pacific

Download or read book The Oxford Handbook of International Law in Asia and the Pacific written by Simon Chesterman and published by Oxford Handbooks. This book was released on 2019-04-28 with total page 904 pages. Available in PDF, EPUB and Kindle. Book excerpt: The growing economic and political significance of Asia has exposed a tension in the modern international order. Despite expanding power and influence, Asian states have played a minimal role in creating the norms and institutions of international law; today they are the least likely to be parties to international agreements or to be represented in international organizations. That is changing. There is widespread scholarly and practitioner interest in international law at present in the Asia-Pacific region, as well as developments in the practice of states. The change has been driven by threats as well as opportunities. Transnational issues such as climate change and occasional flashpoints like the the territorial disputes of the South China and the East China Seas pose challenges while economic integration and the proliferation of specialized branches of law and dispute settlement mechanisms have also encouraged greater domestic implementation of international norms across Asia. These evolutions join the long-standing interest in parts of Asia (notably South Asia) in post-colonial theory and the history of international law. The Oxford Handbook of International Law in Asia and the Pacific brings together pre-eminent and emerging specialists to analyse the approach to and influence of key states of the region, as well as whether truly 'Asian' trends can be identified and what this might mean for international order.

Book Interactions between Regional and Universal Organizations

Download or read book Interactions between Regional and Universal Organizations written by Laurence Boisson de Chazournes and published by BRILL. This book was released on 2016-11-01 with total page 408 pages. Available in PDF, EPUB and Kindle. Book excerpt: Cooperation through international organizations is fundamental to the international legal order. International organizations are nowadays ubiquitous and come in many different manifestations, each allowing for different levels of international cooperation. The profile of regional and universal organizations may vary greatly from one organization to another. At the same time, they do not live apart and this has led to the creation of a complex network of relationships. These relationships have seldom been the object of scholarship, and this book seeks to address that gap. In general, the relationships between international organizations can give rise to such issues as the conditions placed upon one organization by another, demarcations of competence, membership of other organizations, and various forms of collaboration involving the conclusion of agreements between organizations. Optimal coexistence, cooperation and coherence all play a role in optimizing the relations between international organizations. The volume concludes by analysing current challenges, including those of legal identity, responsibility and accountability, as well as making proposals for reform, such as through the development of a common law between organizations.

Book Hydropolitics in the Third World

Download or read book Hydropolitics in the Third World written by Arun P. Elhance and published by US Institute of Peace Press. This book was released on 1999 with total page 332 pages. Available in PDF, EPUB and Kindle. Book excerpt: With more than 50 percent of the world's landmass covered by river basins shared by two or more states, competition over water resources has always had the potential to spark violence. And growing populations and accelerating demands for fresh water are putting ever greater pressures on already scarce water resources. In this wide-ranging study, Arun Elhance explores the hydropolitics of six of the world's largest river basins. In each case, Elhance examines the basin's physical, economic, and political geography; the possibilities for acute conflict; and efforts to develop bilateral and multilateral agreements for sharing water resources. The case studies lead to some sobering conclusions about impediments to cooperation but also to some encouraging ones--among them, that it may not be possible for Third World states to solve their water problems by going to war, and that eventually even the strongest riparian states are compelled to seek cooperation with their weaker neighbors.

This liber amicorum appears as his term at the Appellate Body of the World Trade Organization draws to a close. In this book 30 of his colleagues offer fresh and provocative insights into many of the areas of international law on which Professor Dr Ehlermann has left his stamp. Topics include: the WTO dispute settlement system; regulation of trade barriers; the first signs of a global jurisprudence; the principle of proportionality; enforcement of competition law; and the place of human rights in European and global integration. This book's evaluations and proposals should find thought-provoking echoes in the minds of all those concerned with any of the integration processes under way in today's interdependent world
