It tells its followers how to lead a happy and prosperous life, here and hereafter. Almighty Allah's last and final Prophet, Muhammad (Pbuh) preached a goodfor- all-times religion in this world over 1400 years back in the Arabian desert. When the Prophet (Pbuh) opened his eyes in this world, the Land of Arabia was completely engulfed in inhuman and utterly barbarous practices. There was no room for mercy and compassion in stony-hearted people of Arabia. Seeing this utterly ignoble and pathetic condition, Allah, the Mighty and Powerful, decided to change the age-long tradition, prevailing among the pagans. These people were not known to education, rights of human beings, neighbours, parents and even the Divine Creator. Hence, Allah, the Almighty, sent the most beloved of his prophets and messengers (peace be upon them) and named him "Muhammad", which means, the 'praised' and 'applauded one'

Book International Human Rights and Islamic Law

Download or read book International Human Rights and Islamic Law written by Mashood A. Baderin and published by OUP Oxford. This book was released on 2003-09-11 with total page 302 pages. Available in PDF, EPUB and Kindle. Book excerpt: This volume examines the important question of whether or not international human rights and Islamic law are compatible. It asks whether Muslim States can comply with international human rights law whilst adhering to Islamic law. The traditional arguments on this subject are examined and responded to from both international human rights and Islamic legal perspectives. The volume engages international human rights law in theoretical dialogue with Islamic law, facilitating an evaluation of the human rights policy of modern Muslim States. International Human Rights and Islamic Law formulates a synthesis between these two extremes, and argues that although there are differences of scope and application, there is no fundamental incompatibility between these two bodies of law. Baderin argues that their differences could be better addressed if the concept of human rights were positively established from within the themes of Islamic law, rather than by imposing it upon Islamic law as an alien concept. Each article of the International Covenant on Civil and Political Rights, and the International Covenant on Economic, Social and Cultural Rights, as well as relevant articles of the Convention on the Elimination of All Forms of Discrimination against Women are analysed in the light of Islamic law. The volume concludes that it is possible to harmonise the differences between international human rights law and Islamic law through the adoption of the 'margin of appreciation' doctrine by international human rights treaty bodies and the utilization of the Islamic law doctrines of 'maqâsid al-sharî'ah' (the overall objective of Sharî'ah) and 'maslahah' (welfare) by Muslim States in their interpretation and application of Islamic law respectively. Baderin asserts that Islamic law can serve as an important vehicle for the guarantee and enforcement of international human rights law in the Muslim world, and the volume concludes with recommendations to that effect.

Available in PDF, EPUB and Kindle. Book excerpt: For the first time, the author has explored the intertwinement of written law, Islamic law, and customary law in the highly complex Afghan society, being deeply influenced by traditional cultural and religious convictions. Given these facts, the author explores how to bridge the exigencies of a human rights–driven penal law and conflicting social norms and understandings by using the rich tradition of Islamic law and its possible openness for contemporary rule of law standards. This work is based on ample field research in connection with a thorough analysis of the normative contexts. It is a landmark, since it offers broadly acceptable and thus feasible solutions for the Afghan legal practice. The book is of equal interest for scientists and practitioners interested in legal, religious, social, and political developments concerning human rights and regional traditions in the MENA region, in Afghanistan in particular.

Book International encyclopaedia of Islam

Download or read book International encyclopaedia of Islam written by A. H. Qasmi and published by Gyan Publishing House. This book was released on 2006 with total page 334 pages. Available in PDF, EPUB and Kindle. Book excerpt: Islam is a perfect faith and way of life. It is a complete system in itself, for the life in this world and the next world. For knowing Islam, it is essential to study its philosophy, ideology and principles and for that, one has to approach original sources, viz. Holy Quran and Tradition. However, it is not possible for every one to refer to these sources, which are originally in Arabic. Of course, there are commentaries and explanatory books in Persian, Urdu as well as in English and other western languages. Still, it remains difficult to take benefit of these voluminous secondary sources. Hence, a dire need for a comprehensive and exhaustive work on Islam was felt. This exclusive multi-volume is aimed at filling that room. The International Encyclopaedia of Islam consists of nine volumes and successfully covers all important aspects of Islam, as a religion and faith. These volumes, namely are: 1. Islamic Philosophy, 2. Faith in Islam, 3. Principles of Islam, 4. Islamic Manners, 5. Islam and Social Justice, 6. Judicial System in Islam, 7. Human Rights in Islam, 8. Islam and Education, 9. Science and Islam. These volumes virtually cover the whole Islam in a nutshell, which makes them reader-friendly. This multi-volume is essential for all scholars, researchers, students and general readers, the world over.
