Book Marxism and Psychoanalysis

Download or read book Marxism and Psychoanalysis written by David Pavon-Cuellar and published by Taylor & Francis. This book was released on 2016-12-19 with total page 243 pages. Available in PDF, EPUB and Kindle. Book excerpt: The methods developed by Freud and Marx have enabled a range of scholars to critically reflect upon the ideological underpinnings of modern and now postmodern or hypermodern western societies. In this intriguing book, the discipline of psychology itself is screened through the twin dynamics of Marxism and psychoanalysis. David Pavón-Cuéllar asks to what extent the terms, concerns and goals of psychology reflect, in fact, the dominant bourgeois ideology that has allowed it to flourish. The book charts a gradual psychologization within society and culture dating from the nineteenth century, and examines how the tacit ideals within mainstream psychology – creating good citizens or productive workers – sit uneasily against Marx and Freud’s ambitions of revealing fault-lines and contradictions within individualist and consumer-oriented structures. The positivist aspiration of psychology to become a natural science has been the source of extensive debate, critical voices asserting the social and cultural contexts through which the human mind and behaviour should be understood. This challenging new book provides another voice that, in addressing two of the most influential intellectual traditions of the past 150 years, widens the debate still further to examine the foundations of psychology.

Book The Routledge International Handbook of Shared Parenting and Best Interest of the Child

Download or read book The Routledge International Handbook of Shared Parenting and Best Interest of the Child written by José Manuel de Torres Perea and published by Routledge. This book was released on 2021-05-26 with total page 472 pages. Available in PDF, EPUB and Kindle. Book excerpt: This multidisciplinary volume offers an essential, comprehensive study of perspectives on the scope and application of the best interests of the child and focuses mainly on its application in relation to child custody. With expert contributions from psychological, sociological and legal perspectives, it offers scientific analysis and debate on whether it should be the primary consideration in deciding child custody cases in cases of divorce or separation or whether it should be one of several primary considerations. It explores complex dilemmas inherent in shared parenting and whether the advantages it offers children are sufficient when compared to attributing custody to one parent and limiting visitation rights of the other. Offering a comprehensive analysis of this complex topic, chapters provide detailed insight into the current state of research in this area, as well as expert guidelines aimed at resolving the controversies when parents agree or disagree over their children’s living arrangements. Cutting-edge topics explored include: transnational shared parenting; alternative dispute resolution; breastfeeding parents; religious disputes between parents and the psychological, social and economic factors that affect shared parenting. The Routledge International Handbook of Shared Parenting and Best Interest of the Child will be essential reading for scholars and graduate students in law, psychology, sociology and economics interested in shared parenting and family law.

Download or read book The New Global Law written by Rafael Domingo and published by Cambridge University Press. This book was released on 2010-02-26 with total page 241 pages. Available in PDF, EPUB and Kindle. Book excerpt: The dislocations of the worldwide economic crisis, the necessity of a system of global justice to address crimes against humanity, and the notorious 'democratic deficit' of international institutions highlight the need for an innovative and truly global legal system, one that permits humanity to re-order itself according to acknowledged global needs and evolving consciousness. A new global law will constitute, by itself, a genuine legal order and will not be limited to a handful of moral principles that attempt to guide the conduct of the world's peoples. If the law of nations served the hegemonic interests of Ancient Rome, and international law served those of the European nation-state, then a new global law will contribute to the common good of all humanity and, ideally, to the development of durable world peace. This volume offers a historical-juridical foundation for the development of this new global law.

Download or read book Latin American Law written by M. C. Mirow and published by University of Texas Press. This book was released on 2004-05-01 with total page 368 pages. Available in PDF, EPUB and Kindle. Book excerpt: "M.C. Mirow has set himself a difficult task, to contribute a one-volume introduction to Latin American law in English, and he has succeeded admirably." —Law and History Review "The impressive scope of this book makes it a major contribution to Latin American legal history. . . . This is an excellent starting place for anyone interested in the legal history of the region, and it is essential reading for those seeking to understand the roots of contemporary Latin American politics and society." —Lauren Benton, New York University, author of Law and Colonial Cultures: Legal Regimes in World History, 1400-1900 Private law touches every aspect of people's daily lives—landholding, inheritance, private property, marriage and family relations, contracts, employment, and business dealings—and the court records and legal documents produced under private law are a rich source of information for anyone researching social, political, economic, or environmental history. But to utilize these records fully, researchers need a fundamental understanding of how private law and legal institutions functioned in the place and time period under study. This book offers the first comprehensive introduction in either English or Spanish to private law in Spanish Latin America from the colonial period to the present. M. C. Mirow organizes the book into three substantial sections that describe private law and legal institutions in the colonial period, the independence era and nineteenth century, and the twentieth century. Each section begins with an introduction to the nature and function of private law during the period and discusses such topics as legal education and lawyers, legal sources, courts, land, inheritance, commercial law, family law, and personal status. Each section also presents themes of special interest during its respective time period, including slavery, Indian status, codification, land reform, and development and globalization.

Book A Three Dimensional Theory of Law

Download or read book A Three Dimensional Theory of Law written by María José Falcon y Tella and published by BRILL. This book was released on 2010-04-27 with total page 392 pages. Available in PDF, EPUB and Kindle. Book excerpt: What this book intends to do is to study three-dimensionalism (the distinction values-norms-facts) not in what could be called its historical dimension, but in its substantive aspect, as a “form” that, when applied to different legal themes, would add a “material content” to the three-dimensional theory. We can point out, as a study plan, the distinction between “three” perspectives: Those of the legal norm, of the legal order, and the legal relationship. Three-dimensionalism also appears in this work when one analyzes the “three” phases of the life of the law: The formation, the interpretation, and the application; and in the distinction between the “three” characteristics of the legal order: Fullness, coherence, and unity—the theory of legal validity, intended as legitimacy, as validity strictly speaking, or as effectiveness.

Book Indigenous Movements Self Representation and the State in Latin America

Download or read book Indigenous Movements Self Representation and the State in Latin America written by Kay B. Warren and published by University of Texas Press. This book was released on 2010-07-22 with total page 305 pages. Available in PDF, EPUB and Kindle. Book excerpt: Throughout Latin America, indigenous peoples are responding to state violence and pro-democracy social movements by asserting their rights to a greater measure of cultural autonomy and self-determination. This volume's rich case studies of movements in Colombia, Guatemala, and Brazil weigh the degree of success achieved by indigenous leaders in influencing national agendas when governments display highly ambivalent attitudes about strengthening ethnic diversity. The contributors to this volume are leading anthropologists and indigenous activists from the United States and Latin America. They address the double binds of indigenous organizing and "working within the system" as well as the flexibility of political tactics used to achieve cultural goals outside the scope of state politics. The contributors answer questions about who speaks for indigenous communities, how indigenous movements relate to the popular left, and how conflicts between the national indigenous leadership and local communities play out in specific cultural and political contexts. The volume sheds new light on the realities of asymmetrical power relations and on the ways in which indigenous communities and their representatives employ Western constructions of subjectivity, alterity, and authentic versus counterfeit identity, as well as how they manipulate bureaucratic structures, international organizations, and the mass media to advance goals that involve distinctive visions of an indigenous future.

Book The Liberating Philosophy of Ignacio Ellacur a

Download or read book The Liberating Philosophy of Ignacio Ellacur a written by Luis Arturo Martínez Vásquez and published by Lexington Books. This book was released on 2024-01-16 with total page 307 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Liberating Philosophy of Ignacio Ellacuría: Historical Reality, Humanism, and Praxis is the first systematic work on the philosophy of Ignacio Ellacuría to be published in English so far. The Spaniard-Salvadorian philosopher—murdered in Salvador in 1989 by the military—maintains that philosophy is a permanent task grounded in metaphysics as first philosophy, as developed within a historical reality and a preferential option for the poor. As explored by this collection edited by Luis Arturo Martínez Vásquez, Randall Carrera Umaña, and Luis Rubén Díaz Cepeda, Ellacuría's theory is a critical and practical proposal immersed in the colonial history of Central America, but its explanatory and normative power extends to oppressed people all around the world. The contributors to this volume, coming from Spain, Mexico, Argentina, Salvador, and Costa Rica, analyze Ellacuría's philosophy of liberation in conjunction with radical realism and strength, describing it as "a philosophy created by people concerned with the problems and history of our land—such as our colonial past, systemic poverty and dependency—and… responding to these concerns can offer alternatives for a true liberation of all the dominated peoples of the world."

Book Ontopoietic Expansion in Human Self Interpretation in Existence

Download or read book Ontopoietic Expansion in Human Self Interpretation in Existence written by Anna-Teresa Tymieniecka and published by Springer Science & Business Media. This book was released on 2012-12-06 with total page 416 pages. Available in PDF, EPUB and Kindle. Book excerpt: The societal web of life is underpinned by one concept - that of Self and Other - which emerged earlier in this century. The concept has received a new formulation within the field of the phenomenology of life and the human creative condition, finding a foothold, a point of reference that radiates novel, seminal insights. It is nothing other than the creative fulcrum of human functioning. The self-individualisation of the human being, as revealed in the present collection, is existentially and vitally intertwined with that of the Other. Tymieniecka's seminal idea of the `trans-actional' is explored in this collection of essays, which reveals a variety of significant perspectives, weaving the cycles of the human universe of existence in an essential oscillation between the Self and the Other. In this oscillation we throw out our existential tentacles, trying to gain a living space with respect to each other, all the while engaging in a mutual creative prompting and attunement.

Book Criminal Law and Morality in the Age of Consent

Download or read book Criminal Law and Morality in the Age of Consent written by Aniceto Masferrer and published by Springer Nature. This book was released on 2021-02-09 with total page 361 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book discusses the relation between morality and politics, and morality and law, a field that has been studied for more than two thousand years The law is a part of human culture, and this touches upon a dynamic reality that is connected to the relation between nature and freedom, nature and culture. If such relations are not clearly understood, as is the case today, the relation between morality and law cannot be properly comprehended either. The relationship between morality and criminal law must constantly evolve to meet the needs of changing times and circumstances. Social changes and new situations require new answers. And since the relationship involves criminal law, legal philosophy and legal history, interdisciplinary approaches are always needed. Featuring fifteen original contributions by legal scholars from various European and American universities, the book does not pretend to solve the complexity of the relation between morality and criminal law, but instead expresses criticism, offers some proposals and stimulates further thought. The book tackles the topic from an interdisciplinary perspective (criminal law, constitutional law, legal philosophy and legal history, among others). As such, it appeals not only to scholars and students, but also to lawyers, policymakers, historians, theologians, philosophers and general readers who are interested in the legal, social, political and philosophical issues of our time.
