Available in PDF, EPUB and Kindle. Book excerpt: Derived from the renowned multi-volume International Encyclopaedia of Laws, this very useful analysis of constitutional law in France provides essential information on the country’s sources of constitutional law, its form of government, and its administrative structure. Lawyers who handle transnational matters will appreciate the clarifications of particular terminology and its application. Throughout the book, the treatment emphasizes the specific points at which constitutional law affects the interpretation of legal rules and procedure. Thorough coverage by a local expert fully describes the political system, the historical background, the role of treaties, legislation, jurisprudence, and administrative regulations. The discussion of the form and structure of government outlines its legal status, the jurisdiction and workings of the central state organs, the subdivisions of the state, its decentralized authorities, and concepts of citizenship. Special issues include the legal position of aliens, foreign relations, taxing and spending powers, emergency laws, the power of the military, and the constitutional relationship between church and state. Details are presented in such a way that readers who are unfamiliar with specific terms and concepts in varying contexts will fully grasp their meaning and significance. Its succinct yet scholarly nature, as well as the practical quality of the information it provides, make this book a valuable time-saving tool for both practising and academic jurists. Lawyers representing parties with interests in France will welcome this guide, and academics and researchers will appreciate its value in the study of comparative constitutional law.

Available in PDF, EPUB and Kindle. Book excerpt: Few would disagree that Western democracies are experiencing a crisis of representation. In the United States, gerrymandering and concentrated political geographies have placed the Congress and state legislatures in a stranglehold that is often at odds with public opinion. Campaign financing ensures that only the affluent have voice in legislation. Europeans, meanwhile, increasingly see the European Union as an anti-democratic body whose “diktats” have no basis in popular rule. The response, however, has not been an effective pursuit of better representation. In Good Government, Pierre Rosanvallon examines the long history of the alternative to which the public has gravitated: the empowered executive. Rosanvallon argues that, faced with everyday ineptitude in governance, people become attracted to strong leaders and bold executive action. If these fail, they too often want even stronger personal leadership. Whereas nineteenth-century liberals and reformers longed for parliamentary sovereignty, nowadays few contest the “imperial presidency.” Rosanvallon traces this history from the Weimar Republic to Charles De Gaulle’s “exceptional” presidency to the Bush-Cheney concentration of executive power. Europeans rebelling against the technocratic EU and Americans fed up with the “administrative state” have turned to charismatic figures, from Donald Trump to Viktor Orbán, who tout personal strength as their greatest asset. This is not just a right-wing phenomenon, though, as liberal contentment with Obama’s drone war demonstrates. Rosanvallon makes clear that contemporary “presidentialism” may reflect the particular concerns of the moment, but its many precursors demonstrate that democracy has always struggled with tension between popular government and concentrated authority.

Book Democratic Legitimacy

Download or read book Democratic Legitimacy written by Pierre Rosanvallon and published by Princeton University Press. This book was released on 2011-07-05 with total page 244 pages. Available in PDF, EPUB and Kindle. Book excerpt: It's a commonplace that citizens in Western democracies are disaffected with their political leaders and traditional democratic institutions. But in Democratic Legitimacy, Pierre Rosanvallon, one of today's leading political thinkers, argues that this crisis of confidence is partly a crisis of understanding. He makes the case that the sources of democratic legitimacy have shifted and multiplied over the past thirty years and that we need to comprehend and make better use of these new sources of legitimacy in order to strengthen our political self-belief and commitment to democracy. Drawing on examples from France and the United States, Rosanvallon notes that there has been a major expansion of independent commissions, NGOs, regulatory authorities, and watchdogs in recent decades. At the same time, constitutional courts have become more willing and able to challenge legislatures. These institutional developments, which serve the democratic values of impartiality and reflexivity, have been accompanied by a new attentiveness to what Rosanvallon calls the value of proximity, as governing structures have sought to find new spaces for minorities, the particular, and the local. To improve our democracies, we need to use these new sources of legitimacy more effectively and we need to incorporate them into our accounts of democratic government. An original contribution to the vigorous international debate about democratic authority and legitimacy, this promises to be one of Rosanvallon's most important books.

Book excerpt: Following the profile of recent issues of the Yearbook, volume 13 (2009) of Redescriptions focuses on contemporary debates around the concept of democracy. Several articles, by scholars from different fields (political theory, philosophy, history, rhetoric, women's studies, law), discuss the present state and future prospects of democracy, its relationship to other concepts (deliberation, rhetoric, parliament, majority vs. minority) as well as its (in)compatibility with the power of the courts and the expertise. In this volume examples of conceptual histories are provided by articles on women's suffrage and friendship.
