Book excerpt: This document reports on a congressional subcommittee's review of the federal role in education. The review included visits to 15 states and testimony from more than 225 principals, teachers, and other education stakeholders. The committee's purpose was to identify the steps that lead in the direction of either excellence or failure. The subcommittee found that successful schools and school systems were not the product of federal funding but instead were characterized by parents involved in the education of their children, local control, emphasis on basic academics, and dollars spent on the classroom. The central theme of the findings is that the federal government cannot consistently replicate success stories in the form of federal programs. Rather, the government should empower parents by reducing the family federal tax burden; encourage parental choice in education; return federal elementary and secondary education funds to states and local school districts through flexible grants; use federally funded education programs only for methods backed by reliable, replicable research; streamline and consolidate federal education programs; and reform or eliminate ineffective and inefficient programs. In short, the federal government should serve education as a research and statistics- gathering agency, disseminating findings and enabling states to share best practices with each other. The report was adopted by the subcommittee by a vote along Republican-Democrat party lines of 5-2. The 17 page minority report, "Crossroads Hearings: A Republican Assault on Public Education," is printed as an appendix. (RJM)

Following an overview of education and the federal government, chapter 1 of the report describes the purposes of federal support for educational programs and discusses the educational reform movement that began in the early 1980s. Chapter 2 profiles elementary and secondary education nationwide, focusing on trends in educational outcomes, school resources, and student and family characteristics, while chapter 3 addresses issues of the relative priority that should be given to equity and excellence in education, and the level of control the government should exercise over education. Chapter 4 describes options for reducing the federal role in education through the use of block grants that define funding purposes but do not specify states' implementation procedures, and chapter 5 discusses options for refining the current federal role through fully funding current programs, eliminating programs not directed to special populations, and focusing on early education. Finally, chapter 6 reviews approaches to promoting educational reform, including national curriculum and national assessment efforts, school-based reform, and modification of key elements of the educational system as a whole. The papers examine the changing dimensions of the federal-state partnership in education. The volume is organized into four sections. The first section is devoted to state educational policy concerns, including various state approaches to improving educational quality, school finance reform, and the states' relationship to special needs students. In the second section, the focus is on lessons states can learn from federal education programs, including material on federal strategies used prior to 1981 to deliver services to target groups such as the disadvantaged or handicapped, federal strategies for educational improvement, and what past experience with different types of federal programs can teach about intervention effectiveness. Consolidated and block grants as an alternative framework for federal-state programs and the probable responses of state education agencies to such programs are the subjects of the third section. The final section offers recommendations for restructuring the federal-state partnership in education, including the suggestion that the federal government adopt differential treatment for states that are merely adapting federal programs and states that are not complying. The suggestion is made that one form of differentiating (waivers) would be expensive and cumbersome. Other recommendations concern school-based strategies for school improvement and federal and state policies that reward improvement of learning. (JM)

Book excerpt: Beginning in 2011, Education used its statutory authority to invite states to apply for waivers from certain provisions in the ESEA through its Flexibility initiative. To receive Flexibility waivers, states had to agree to meet other requirements related to college- and career-ready expectations, school accountability and support, and effective instruction. Education approved Flexibility waivers for 43 states. In December 2015, Congress reauthorized the ESEA which modified Education's waiver authority. GAO was asked to review Education's Flexibility initiative. GAO examined the extent to which Education assessed states' ability to fully implement their Flexibility waivers and the process it used to oversee the waivers. GAO reviewed relevant federal laws, guidance, and key documents related to the Flexibility initiative, such as monitoring reports; and interviewed Education officials. GAO reviewed Education's documents and identified states facing multiple challenges in implementing their waivers. GAO also interviewed officials in five states, selected to reflect a range of challenges states faced in implementing the waivers.

This study has three main purposes: (1) to analyze the structure and evolution of the legislative and regulatory requirements in order to determine the specific intentions that motivated the design of these provisions; (2) to assess the incidence and etiology of noncompliance; and (3) to analyze alternative policy responses in the event it was found that a substantial number of districts were not complying with the requirements whose enforcement might have inequitable and/or inefficient consequences. Chapter II describes current MOE regulations for four major federal education programs. Chapter III summarizes and organizes findings from the states visited. Chapter IV is an analysis of the findings. In the course of visits to the state capitals, each official interviewed was asked to suggest desirable changes in MOE provisions. Their views are summarized in Appendix A.
