Book excerpt: In November of 2006, California voters passed Proposition 83, also known as the "Sexual Predator Punishment and Control Act: Jessica's Law" or simply, Jessica's Law. This law not only enforced the use of GPS surveillance units to track all convicted sex offender parolees, including juveniles, for the rest of their lives, but it also enforced a strict 2000-foot residency restriction thus greatly limiting the locations of where parolees can live and work. As a result, the number of registered sex offenders has increased as well as the amount of money used to fund such popular surveillance policies. Since the passing of Jessica's Law, the California Department of Corrections and Rehabilitation (CDCR) now leads the nation in the use of GPS surveillance for the community management of sex offenders on parole. The use of GPS to track sex offender parolees is driven by several factors including the desire to control re-offending behavior and to "keep kids and communities safe." However, studies conducted on recidivism rates for released offenders question whether or not these expectations are, in fact, realistic. This dissertation begins with a discussion of the history of electronic monitoring schemes used within the United States criminal justice system. Charting the uses of surveillance technology throughout the past 40 years, findings suggest that growth is widespread and changing. Additionally, this dissertation details changes in sex offender legislation including legal justifications and political rhetoric associated with current law. Most importantly, this dissertation utilizes qualitative data from focus groups with sex offender parolees on GPS. Findings indicate that Jessica's Law, as a criminal justice policy, does little to help reintegrate or rehabilitate parolees, nor does it effectively curtail reoffending behavior. Instead, analysis within this dissertation demonstrates how Jessica's Law and GPS technology are counterproductive, exclusionary, and costly.

Book excerpt: Electronic monitoring (EM) is a way of supervising offenders in the community whilst they are on bail, serving a community sentence or after release from prison. Various technologies can be used, including voice verification, GPS satellite tracking and – most commonly - the use of radio frequency to monitor house arrest. It originated in the USA in the 1980s and has spread to over 30 countries since then. This book explores the development of EM in a number of countries to give some indication of the diverse ways it has been utilized and of the complex politics which surrounds its use. A techno-utopian impulse underpins the origins of EM and has remained latent in its subsequent development elsewhere in the world, despite recognition that is it less capable of effecting penal transformations than its champions have hoped. This book devotes substantive chapters to the issues of privatisation, evaluation, offender perspectives and ethics. Whilst normatively more committed to the Swedish model, the book acknowledges that this may not represent the future of EM, whose untrammelled, commercially-driven development could have very alarming consequences for criminal justice. Both utopian and dystopian hopes have been invested in EM, but research on its impact is ambivalent and fragmented, and EM remains undertheorised, empirically and ethically. This book seeks to redress this by providing academics, policy audiences and practitioners with the intellectual resources to understand and address the challenges which EM poses.

Any deprivation of liberty inevitably affects social ties, breaks family relations, often causes the loss of a job or a home and harms the prospects for employment and housing after release. It also contributes in general to the social exclusion of offenders and increases the risks of reoffending. The use of electronic monitoring alone can only be effective for reducing the risk of re-offending in the short term. In order to have long-term results and contribute to desistance from crime this supervision measure needs to be combined with treatment and assistance interventions. The need for common standards and principles at European level regarding the use, duration and deontology regarding electronic monitoring has resulted in the adoption of Recommendation CM/Rec(2014)4 of the Committee of Ministers of the Council of Europe.

This report examines its cost effectiveness and covers: whether breaches of curfew are detected and dealt with promptly; the cost compared to custody; the impact on the offending behaviour. The main conclusion is that electronic tagging does offer value for money but effectiveness is undermined by delays in fitting tags and delays in responding to breaches of curfew.

Evidence on the effects of EM on criminal recidivism is, however, limited and it is unclear how this alternative to incarceration affects the labor market outcomes of offenders. Moreover, little is known about potential spillover effects on family members. We study the introduction of EM in Sweden in 1997 wherein offenders sentenced to up to three months in prison were given the possibility to avoid entering prison by substituting to EM. Our difference-in-differences estimates comparing the change in the prison inflow rate of eligible offenders to that of non-eligible offenders with slightly longer sentences show that the reform dramatically decreased incarcerations. Our main finding is that EM lowers criminal recidivism and improves offenders' labor market outcomes. There is also some evidence of improvements in the short and intermediate run outcomes of the children of the offenders. The main channels through which EM operates seem to be by allowing offenders to maintain regular work and potentially also by reducing employer discrimination. Our calculations suggest that the social benefits of EM are at least six to nine times larger than the fiscal savings from reduced prison expenditure. This makes the welfare improvements from EM potentially much greater than what has been previously recognized.
