Book excerpt: 'Wayleave' is an archaic term from the nineteenth century defined as 'a privilege enabling a person to cross another person’s land with infrastructure and with goods and chattels'. It has been applied to electricity rights because of the need to string electricity lines across land. Electricity is such a fundamental part of life that its supply is often taken for granted. In reality, the rights for electricity lines are arguably the weakest of all utilities, with the vast majority covered by wayleaves. Privatisation in the 1990s provided the opportunity to bolster wayleave rights, but it only led to a tinkering through primary legislation. The acceleration of telecommunications over the past twenty years has confused issues, with operators installing masts and adding apparatus to electricity lines. A large proportion of wayleaves are dealt with at local level, with little consistency. Coupled to this is the public concern that electricity lines have potentially serious health effects that continue to attract research and media interest. This book has been written for those involved in, or advising on, the use and development of land for transmission and distribution lines. As most people have only brief encounters with the electricity infrastructure, this guide will help to avoid the fear of the unknown. The Code strikes a balance between the rights and interests of landowners and network operators. This consultation paper discusses the current law and set out a number of provisional proposals and options for reform. The paper considers all the main provisions of the current Code and areas highlighted for potential reform include: the rights of operators and landowners under the Code, and the position of third parties; operators' obligations under the Code and related regulations; the test applied to determine whether code rights are granted to an operator where a landowner objects; the measure of the financial award to be paid to the landowner where an operator is granted code rights; the appropriate forum for the resolution of disputes, and other procedural issues; the interaction between the Code and other statutory regimes. The Code applies throughout the UK. The Commission's focus is on the law in England and Wales, but the project is being conducted in consultation with the Scottish and Northern Irish Law Commissions.

The extent to which such attitudes are reflected in lower property values is not well understood. Towers, Turbines and Transmission Lines: Impacts on Property Value outlines results of studies conducted in the US, the UK, Australia and New Zealand and offers guidance to valuers as well as to property/real estate appraisal students and property owners around the world. The book provides defensible tools that are becoming widely accepted to assess the effect that these environmental detriments have on property prices.
