Book excerpt: In 2020, as Latin American countries shuttered their economies, it became clear that effective lockdowns would require states to provide income support. In a region that has historically struggled to build systems of social protection, the effort to expand benefits was notable. Policies varied in scope and generosity, but in what seemed to signify a new era of state-building, Latin American democracies demonstrated a nearly uniform commitment to providing assistance to the poor. Why did some countries implement broader and more adequate programs than others and why did countries vary in their ability to sustain support over time? This Element argues that three factors explain cross-national and cross-temporal differences in policy effort: policy legacies, unified/divided government, and fiscal space. The study shows that in settings of crisis, the democratic politics of social policy expansion shift, with traditional factors like ideology and electoral competition playing a less central role.

It proffers an overview on the social development and political measures, from both the Global North and Global South, to prevent COVID-19's spread. It illuminates major social, political and economic challenges that already existed in different contexts and which are also currently being amplified by COVID-19. Curiously, this global pandemic has opened spaces for different actors, across the globe, to begin to fundamentally question and challenge the hegemony of the Global North, which sometimes is evident in social work. Linked to the foregoing and while reflecting beyond the pandemic and into the future, the book proposes that social work must become more political at all levels, and strive to transform societies, global social development efforts, and economic and health systems. This contributed volume of 38 chapters discusses and analyses ethical, social, sociological, social work and social development issues that complement and enrich available literature in the socio-political, economics, public health, medical ethics and political science. Public power can only be legitimately exercised if it is based on and complies with the law. The Constitution and its fundamental values – human dignity, freedom and equality – are the ultimate sources of orientation for the rule of law. Domestic rule of law is complemented by its external dimension, the duty to respect international law and, for EU member states, supranational law. For the World Jurist Association, the realization of the Rule of Law has been the central concern since its founding more than 60 years ago. Its biennial world congresses, which bring together leading figures from politics, the judiciary and academia under the presidency of Javier Cremades, focus on the universal importance of the rule of law, which experts from numerous countries discuss on the basis of current problem areas. At the 2021 World Law Congress in Barranquilla, Colombia, one central topic was the tension between combating pandemics and the rule of law. The contributions gathered here examine how this challenge was met in political-legal practice, and the role of constitutional jurisdiction in the process. They analyze and evaluate the legal situation in numerous countries in Europe and Latin America. In addition, they reflect on fundamental issues, such as the concept of the rule of law, its relationship to democracy, its universal character and its implementation via jurisprudence.

Más allá del impacto inmediato sobre el nivel de empleo, la crisis está profundizando y acelerando la transformación del empleo, anticipando el futuro. Efecto viral: COVID-19 y la transformación acelerada del empleo en América Latina y el Caribe se enfoca en las tendencias subyacentes que han estado cambiando significativamente el mercado laboral en la región: la desindustrialización prematura, la servicificación de la economía y los cambios en las habilidades requeridas en los empleos a medida que avanza la automatización. Las conclusiones de este informe tienen varias implicancias importantes para la política económica. Algunas de estas implicancias están relacionadas con los desafíos de productividad a los que ya se enfrentaba América Latina y el Caribe después del final de la Década Dorada en 2013. Otras implicancias políticas podrían comenzar a ganar relevancia por la crisis de COVID-19. A medida que los sectores se ven afectados de diferentes maneras y el trabajo a distancia se vuelve más común, los Gobiernos deben responder con medidas que apoyen una transformación fluida de los puestos de trabajo, que sean socialmente aceptables y que contribuyan al crecimiento de la productividad, incluida la inversion en el capital humano de la fuerza de trabajo. La transformación acelerada de los puestos de trabajo exige un nuevo planteamiento de la normativa laboral y las políticas de protección social. Los países de América Latina y el Caribe desarrollaron una arquitectura institucional orientada a los trabajadores asalariados del sector formal, que rápidamente se está volviendo anticuada. El informe, por ende, refiere a una agenda política que se ocupe de la regulación flexible de las formas emergentes de trabajo de manera que incentive el empleo y apoye la formalización, ampliando así la cobertura de la protección social a segmentos más amplios de la población.

Cities and local governments have been acting decisively to apply the policy measures defined at national level to the specific local conditions. COVID-19 has exposed the inadequacy of the crisis response infrastructures and policies at both national and local levels in these countries as well as in many others across the world. But it also exposed much broader and deeper weaknesses that result from how societies are organized, namely the insecure life a substantial proportion of citizens have, as a result of economic and social policies followed in previous decades, which accentuated the impacts of the lockdown measures on employment, income, housing, among a myriad of other social dimensions. Besides the analysis of how governments, and local government, responded to the public health issues raised by the spread of the virus, the book deals also with the diversity of responses local governments have adopted and implemented in the countries, regions, cities and metropolitan areas. The analysis of these policy responses indicates that previously unthinkable policies can surprisingly be implemented at both national and local levels.
