Book excerpt: A lo largo del presente trabajo se expone el régimen jurídico que el artículo 41 del Estatuto de los Trabajadores establece para la modificación sustancial de condiciones de trabajo. Tras hacer explícitos los objetivos pretendidos y la metodología seguida, en la primera parte se esbozan los márgenes del ius variandi empresarial y el papel de las modificaciones contractuales como mecanismo de flexibilidad interna en la empresa. A continuación, el discurso se detiene en el análisis del concepto de modificación sustancial de condiciones de trabajo para pasar, acto seguido, al estudio de las causas que habilitan el recurso al artículo 41 del Estatuto de los Trabajadores. El bloque final del trabajo se destina, de un lado, a revisar los aspectos procedimentales a seguir en el cambio decidido unilateralmente por la empresa; de otro, a la exposición de las vías de reacción puestas a disposición del trabajador por el ordenamiento. Como cierre, se ofrece la prelación de las conclusiones alcanzadas y de la bibliografía utilizada.

Book excerpt: In many EU Member States, the various economic crises of recent years provided grounds for a rarely equalled level of state intervention in the regulation of labour relations with an explicit aim: the decentralisation of collective bargaining. An extensive body of research – summed up and analysed expertly in the chapters of this very important book – reveals that the process of decentralisation has more often than not led to a situation where salaries and labour conditions are ever more frequently determined by direct negotiations between employer and employees, with the State becoming the sole guarantor of employee protection even as it encourages decreasing labour costs to ensure that companies remain competitive. The comparative approach offered in this book adds to this synthesis by providing examples of speci c recent developments in fourteen Member States and Turkey. In recent years governments in the South have transferred at least 200 million hectares of forests to communities living in and around them . This book assesses the experience of what appears to be a new international trend that has substantially increased the share of the world's forests under community administration. Based on research in over 30 communities in selected countries in Asia (India, Nepal, Philippines, Laos, Indonesia), Africa (Burkina Faso, Cameroon, Ghana) and Latin America (Bolivia, Brazil, Guatemala, Nicaragua), it examines the process and outcomes of granting new rights, assessing a variety of governance issues in implementation, access to forest products and markets and outcomes for people and forests . Forest tenure reforms have been highly varied, ranging from the titling of indigenous territories to the granting of small land areas for forest regeneration or the right to a share in timber revenues. While in many cases these rights have been significant, new statutory rights do not automatically result in rights in practice, and a variety of institutional weaknesses and policy distortions have limited the impacts of change. Through the comparison of selected cases, the chapters explore the nature of forest reform, the extent and meaning of rights transferred or recognized, and the role of authority and citizens' networks in forest governance. They also assess opportunities and obstacles associated with government regulations and markets for forest products and the effects across the cases on livelihoods, forest condition and equity.
