Book La prisi n y las instituciones punitivas en la investigaci n hist rica

Download or read book La prisi n y las instituciones punitivas en la investigaci n hist rica written by Pedro Oliver Olmo and published by Universidad de Castilla La Mancha. This book was released on 2014-09-23 with total page 922 pages. Available in PDF, EPUB and Kindle. Social History of Punitive Institutions in Spain needs meetings and discussions, comparison and collaboration between researchers. Only then it will become visible and intelligible as a historiographical trend and, above all, as a theoretical-methodological hope, because in fact, now it is more than conceivable as a historiographical practice. Here in this book are outlined, along with the achievements, the shortcomings and the most pressing challenges. Far from seeking an extemporaneous autonomy, Social History of Punitive Institutions wants to try to find its own feasibility based on intersections and good mixings. Those objectives were considered by the Study Group about History of Prison and Punitive Institutions (Grupo de Estudio sobre la Historia de la Prisión y las Instituciones Punitivas, GEHPIP) –an interuniversity team and with central office at Universidad de Castilla-La Mancha (UCLM)– when organising what it decided to name in an homonymous way 1st International Congress on History of Prison and Punitive Institutions (I Congreso Internacional sobre Historia de la Prisión y las Instituciones Punitivas), held in Ciudad Real (Spain) from 10 to 12 April 2013. The electronic book here presented is a good example of what it was told and discussed there.

Book Comparative intervention with minors in different countries

Download or read book Comparative intervention with minors in different countries written by Concepción‏ Nieto Morales and published by Dykinson. This book was released on with total page 149 pages. Available in PDF, EPUB and Kindle. Book excerpt: In the present course dedicated to minors, the participants will show us, in a schematic and very clearly way, the legal approach concerning the treatment that the respective States give the child, both in the field of protection, as in the one of the criminal responsibility for the commission of a crime or misdemeanor. Under this view of comparative law, there is the opportunity to meet the criminal procedure applied to children in conflict with the law, the age group from which criminal responsibility is required, the specialization of all the professionals involved from judges, prosecutors, lawyers, police, etc., involved in the area of the minor concerning the adversarial principle or the procedural guarantees for juvenile offenders. Regarding the enforcement of judicial measures, the central axis is education and the socialization of teenagers. However, each country has its own uniqueness and, in custodial measures, the age and type of crime are important in some countries. The part concerning extrajudicial solutions is highly informative, especially the part related to the Institute of mediation, where the participation of the victim is essential. I hope that reading and participation arouse in you the enthusiasm for me experienced, and that the efforts of its participants will be compensated with the learning and sensitization in the treatment of the child... Ana Mª Hermosa Martinez. Prosecutor of the High Court of Andalusia. Section Coordinator. Territorial of Seville. Spain.

Book Conflicts of Criminal Jurisdiction and Transfer of Proceedings in the EU

Download or read book Conflicts of Criminal Jurisdiction and Transfer of Proceedings in the EU written by Alejandro Hernández López and published by Springer Nature. This book was released on 2022-11-21 with total page 231 pages. Available in PDF, EPUB and Kindle. Book excerpt: Framework Decision 2009/948/JHA on the prevention and settlement of conflicts of exercise of jurisdiction in criminal proceedings established an ad hoc procedure for settling conflicts of criminal jurisdiction based on the mutual exchange of information and the establishment of direct consultations between the competent authorities with a view to reaching consensus on an effective solution. However, neither common legally binding criteria for deciding the best jurisdiction nor specific rules for the transfer of proceedings (which can occur after parallel proceedings have been identified) were established in this instrument, or in any other instrument adopted by the EU to date. This book analyses the current EU legal framework on conflicts of jurisdiction and transfer of criminal proceedings, paying special attention to its numerous shortcomings and loopholes from a fundamental rights and due process of law perspective. The book begins with an assessment of the various principles and grounds used by Member States for claiming criminal jurisdiction. Secondly, de lege lata EU procedure on the settlement of conflicts of criminal jurisdiction, as well as its implementation in Spain and Italy, are thoroughly examined. After discussing the main principles and fundamental rights at stake, the author proposes two alternative and original de lege ferenda models for the prevention and settlement of conflicts of criminal jurisdiction and transfer of criminal proceedings, exploring the different possibilities offered by the EU’s primary law.

  • Author : Helena Morão
  • Publisher : Springer Nature
  • Release : 2023-02-10
  • ISBN : 3031130014
  • Pages : 214 pages

Download or read book Fairness in Criminal Appeal written by Helena Morão and published by Springer Nature. This book was released on 2023-02-10 with total page 214 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book addresses the European Court of Human Rights’ fairness standards in criminal appeal, filling a gap in this less researched area of studies. Based on a fair trial immediacy requirement, the Court has found several violations of Article 6 of the European Convention on Human Rights at the appellate level by at least eighteen States of the Council of Europe in a vast array of cases, particularly in contexts of first instance acquittals overturning and of sentences increasing on appeal. On the one hand, the book critically engages this case-law with the law revisions it has recently inspired in European countries, as well as with the critiques and difficulties that it continues to raise. On the other hand, it interweaves insight from criminal procedure theory with new discoveries in the field of cognitive sciences (neuroscience of memory, philosophy of knowledge, AI), shedding an interdisciplinary light on the (in)adequacy and limits of the Strasbourg Court’s jurisprudence.

Book Multilevel Protection of the Principle of Legality in Criminal Law

This book was released on 2017-10-24 with total page 237 pages. Available in PDF, EPUB and Kindle. It does so not only from a theoretical perspective, but also through a comparative study of the jurisdiction of the European Court of Human Rights, the Inter-American Court of Human Rights, the Court of Justice of the European Union and state constitutional courts. This practical approach characterizes the book, which culminates in a detailed analysis of the relevant ECtHR Judgement Del Río Prada v. Spain on the retroactivity of unfavourable jurisprudence."Multilevel protection of the principle of legality in Criminal Law" is a useful instrument of reflection for scholars of both the principle of criminal legality and the problems that arise from the concurrency of protective jurisdictions of human rights.

Book Transnational Inquiries and the Protection of Fundamental Rights in Criminal Proceedings

Download or read book Transnational Inquiries and the Protection of Fundamental Rights in Criminal Proceedings written by Stefano Ruggeri and published by Springer Science & Business Media. This book was released on 2013-01-09 with total page 561 pages. Available in PDF, EPUB and Kindle. Book excerpt: The protection of fundamental rights in the field of transnational criminal inquiries is of great delicateness in the current tangled web of domestic and international legal sources. Due to this complex scenario, this research has been carried out from a four-level perspective. The first part provides a critical analysis of the multilevel systems of protecting fundamental rights from the perspective of supranational and constitutional case law, and in the field of international and organized crime. The second part focuses on EU judicial cooperation in three main fields: financial and serious organized crime, mutual recognition tools, and individual rights protection. The third part provides the perspectives of ten domestic legal systems in two fields, i.e., obtaining evidence abroad and cooperation with international criminal tribunals. The fourth part analyses cross-border inquiries in comparative law, providing a reconstruction of different models of obtaining evidence overseas.
