El derecho a la formación profesional es un derecho intrínseco al trabajador en el marco del contrato de trabajo. Además, es uno de los principales instrumentos para que empresarios y trabajadores se adapten y adecúen a las necesidades y exigencias del mercado de trabajo. En esta línea, las recomendaciones de los organismos internacionales y de la Unión Europea resaltan que los trabajadores han de adquirir las competencias profesionales necesarias para favorecer las transiciones de ocupación y profesión como un fenómeno definitorio del Derecho del Trabajo. La obra aborda el estudio de la dimensión jurídica del permiso de formación para el empleo, vinculado a las actividades de acción formativa de la empresa, como una de las manifestaciones que conforman la configuración legal del apartado tercero del artículo 23 del Estatuto de los Trabajadores (ET). En particular, se estudia, en detalle, la configuración de las distintas iniciativas de formación que conforman el permiso de formación profesional para el empleo, vinculado a la empresa: acciones formativas de la empresa a favor de los trabajadores por iniciativa propia, en el marco de un plan de formación profesional, acudiendo al sistema de formación profesional para el empleo a través del crédito de formación que se asigna a la empresa; acciones formativas comprometidas por la negociación colectiva; permiso individual de formación y permiso anual de veinte horas. Se analiza la determinación de las obligaciones empresariales en el marco del contrato de trabajo, la estructura de participación, el régimen de funcionamiento y financiación del permiso y se repasa la intervención de la negociación colectiva en la regulación de los derechos y obligaciones de formación previstos en el artículo 23.3 ET. La obra también se ocupa de la regulación del derecho de formación profesional de los trabajadores en el ordenamiento jurídico alemán; el Estado define los principios y fundamentos sobre los que reposa el sistema de formación profesional alemán, si bien el desarrollo de su ejercicio se recoge, en las legislaciones de los distintos Länder, con vocación de favorecer el efecto multiplicador y expansivo de la formación en el cambiante mercado de trabajo y las exigencias de éste.
