Book excerpt: El libro que me complace presentar es el resultado de la investigación "Medio ambiente y ordenación del territorio" que el Grupo de Investigación en Derecho del Medio Ambiente de la Universidad Externado de Colombia proyectó con el objetivo de identificar y estudiar los conceptos de planificación y plan, así como algunos ejercicios de ordenación del territorio y de planificación ambiental desarrollados en España y en Colombia, con el fin de identificar el marco jurídico y las políticas públicas que se han desarrollado en la materia, y verificar sus logros y dificultades. Antes de describir el contenido y la estructura del documento partimos por indicar que desde el punto de vista terminológico ordenar implica "Colocar algo o a alguien de acuerdo con un plan o de modo conveniente”, "Encaminar y dirigir algo a un fin" (DRAE, 2014). Entendemos que si nos referimos a la ordenación hablamos de un proceso por medio del cual se ordenan las cosas o los elementos de manera tal que, de llevarse a cabo las etapas identificadas en un plan, se logra el fin que previamente se ha proyectado y delimitado. Ahora bien, siendo el territorio la base sobre la cual se desarrollan múltiples actividades humanas que se ejercen conforme a las delimitaciones determinadas por el ordenamiento jurídico sobre el que se construye el Estado social de derecho, es necesario que además de las herramientas definidas en el marco normativo se construyan y desarrollen instrumentos de planificación y ordenamiento del territorio que le permitan al Estado prescribir una serie de procedimientos que lo impulsen a alcanzar sus objetivos sustanciales.

Book excerpt: Hablar de conflicto es referirse a una situación en la que los actores sociales (instituciones, academia, comunidad y sector productivo), se encuentran en oposición conciente con otros actores, debido a que persiguen objetivos contrarios, lo que los coloca en condiciones de enfrentamiento o confrontación. Por su parte, teniendo en cuenta que el término “ambiental” se refiere a todo proceso que expresa una relación entre el hombre y su entorno, se define el conflicto socio-ambiental como aquel que se produce en el proceso humano de apropiación y transformación de la naturaleza.1 Para América Latina la década del 90 se convierte en el punto de partida para la agudización de los principales conflictos ambientales, porque además de crecer en número, estos conflictos lo hacen en intensidad. En 1992 con la conferencia de las Naciones Unidas sobre el Medio Ambiente y Desarrollo (CNUMAD), se revaloró la importancia de las personas y la calidad de su vida sobre los procesos de desarrollo económico. También se definió la prevención y responsabilidad de los gobiernos sobre estos temas, al grado que su difusión se extendió a las estructuras jurídicas, político-institucionales y de comportamientos sociales amplios, sensibilizándolos sobre los problemas ambientales. A partir de lo anterior es conveniente para esta investigación involucrar el concepto de gestión ambiental local como el manejo participativo de los conflictos socio-ambientales de una región determinada, por parte de los diversos actores sociales; mediante el uso selectivo y combinado de herramientas pertinentes, para lograr el funcionamiento adecuado del ambiente y el mejoramiento de las condiciones de calidad de vida de la población dentro de un marco de sostenibilidad. El gestor ambiental local desempeña el papel de facilitador en la construcción de alternativas de solución para los conflictos socio-ambientales presentes en una determinada comunidad.
