Este aggiornamento está en línea con uno de los propósitos esenciales del Departamento, cual es el de actualizar los diferentes derechos que compren­den la propiedad intelectual, correspondiéndole el turno con esta publicación a los signos distintivos. La primera parte del libro, escrita por Pablo Velasco, está dedicada a los dos grandes sistemas de protección de la marca, esto es, el declarativo y el atributivo con especial análisis en el tema del uso, para afirmarse que este tiene un carácter preponderante incluso en los sistemas atributivos, ampa­rados en el registro, como el que se aplica en Colombia. En efecto, llama la atención cómo el uso en los sistemas de concesión del derecho mediante el registro tiene un valor económico y jurídico que no ha sido desconocido por el ordenamiento nacional o el supranacional ni por la jurisprudencia que con curia se menciona en el trabajo. La relevancia que tiene el uso como elemento dinamizador del sistema de protección sitúa al libro en una nueva perspectiva sui generis que debe ser objeto de estudio de los teóricos y prácticos de esta especial área del de­recho. Se lee en el libro: "Es posible concluir cómo la dinámica del uso ha afectado de manera importante los patrones clásicos de seguridad jurídica y preeminencia del registro que habitualmente informaban los sistemas marcarios atributivos como el andino. En este proceso se puede ver que poco a poco se construye una transición hacia una mayor valoración del uso como un criterio dominante en la vida de una marca, de manera que no pueda ya hablarse en nuestro medio de la existencia de sistemas puramente atributivos, lo mismo que en otros medios ya no pueda hablarse de sistemas puramente declarativos". La segunda parte del texto, de manos de Manuel Guerrero, se refiere a las marcas no tradicionales, es decir, a los nuevos signos distintivos que han venido luchando para obtener reconocimiento en mercados cada vez más competitivos y exigentes que utilizan publicidad sugestiva con la ayuda de los nuevos medios tecnológicos de información. La tercera parte del libro correspondió a Felipe Payán, que dedicó sus esfuerzos al tema de las vicisitudes que afronta el proceso de registro de mar­ca desde la solicitud hasta el acto administrativo de concesión: oposiciones, cancelación por no uso y la acción de nulidad ante el Consejo de Estado, completando su análisis con lo que acontece en los Estados Unidos y Europa. Su perspectiva crítica hace de esta parte del libro una lectura obligada para los agentes de la propiedad industrial en el país.

Esta obra es el resultado de la investigación realizada en los temas más relevantes del derecho de marcas actual en tres sistemas jurídicos, a saber: Comunidad Andina, Unión Europea y Estados Unidos. El objetivo fundamental de la investigación se centró en identificar los asuntos que más controversias generan ante tribunales y sedes administrativas, y estudiar la manera como estos se solucionan por la legislación y la jurisprudencia de los sistemas jurídicos seleccionados. Esperamos que los contenidos de este estudio sean de utilidad no solo para la comunidad académica, sino también para todo aquel que esté interesado en la práctica jurídica del derecho de marcas.

Mauricio Tenorio-Trillo contrasts Mexico's presence at the 1889 Paris fair—where its display was the largest and most expensive Mexico has ever mounted—with Mexico's presence after the 1910 Mexican Revolution at fairs in Rio de Janeiro in 1922 and Seville in 1929.
