Against the Current: Privatization, Water Markets, and the State in Chile is the first empirical and interdisciplinary study of water markets in Chile, which is the leading international example of free market water policies. Against the Current: Privatization, Water Markets, and the State in Chile challenges the glowing reports given by neoliberals in Chile and the World Bank, showing that the results of this economic experiment have actually been rather mixed. Within the agricultural sector the Water Code has worked fairly well, although the market incentives to conserve water have been ineffective and water rights trading has been less active than expected. The Code's impact has been more negative at the level of river basins, where the institutional framework has revealed critical flaws in coordinating multiple water users and resolving conflicts. Esta emergencia de lo común en la acción reclama un trabajo de clarificación en el pensamiento. El sentido actual de lo común se distingue de los numerosos usos que se ha dado a esta noción, ya sean filosóficos, jurídicos o teológicos: bien supremo de la ciudad, universalidad de esencia, propiedad inherente a ciertas cosas, incluso alguna vez el fin perseguido por la creación divina. Pero hay otro hilo que vincula lo común, no a la esencia de los hombres o a la naturaleza de las cosas, sino a la actividad de los hombres mismos: sólo una práctica de puesta en conjunto puede decidir qué es “común”, reservar ciertas cosas al uso común, producir determinadas reglas capaces de obligar a los hombres. En este sentido, lo común reclama una nueva institución de la sociedad por ella misma: una revolución.

Focusing specifically on indigenous women, this book analyses how they, often in alliance with supporters and allies, have sought to improve their access to justice. Development practitioners working in the field of access to justice have tended to conceive indigenous legal systems as either inherently incompatible with women’s rights or, alternatively, they have emphasised customary law’s advantageous features, such as its greater accessibility, familiarity and effectiveness. Against this background – and based on a comparison of six thus far underexplored initiatives of legal and institutional change in Ecuador, Peru, and Bolivia – Anna Barrera Vivero provides a more nuanced, ethnographic, understanding of how women navigate through context-specific constellations of interlegality in their search for justice. In so doing, moreover, her account of ongoing political debates and local struggles for gender justice grounds the elaboration of a comprehensive conceptual framework for understanding the legally plural dynamics involved in the contestation of discriminatory gender norms.
