Based on research across many countries, it discusses the goals of privacy protection policy and the changing discourse surrounding the privacy issue, concerning risk, trust and social values. It analyzes at length the contemporary policy instruments that together comprise the inventory of possible solutions to the problem of privacy protection. It argues that privacy protection depends upon an integration of these instruments, but that any country's efforts are inescapably linked with the actions of others that operate outside its borders. The book concludes that, in a ’globalizing’ world, this regulatory interdependence could lead either to a search for the highest possible standard of privacy protection, or to competitive deregulation, or to a more complex outcome reflecting the nature of the issue and its policy responses.

The rights derived from Union law can be enforced in court, as opposed to other international organisations whereby enforceability is often far less certain. At the heart of the system of judicial protection in the European Union is the core principle of upholding the rule of law. As such, the stakes are high in the sense that the system of the judicial protection in the European Union must live up to its promise in which individuals, Member States and Union institutions are all guaranteed a route by which to enforce Union law rights. This book provides a rigorously structured analysis of the EU system of judicial protection and procedure before the Union courts. It examines the role and the competences of the Union courts and the types of actions that may be brought before them, such as the actions for infringement, annulment, and failure to act, as well as special forms of procedure, for example interim relief, appeals, and staff cases. In doing so, special attention is given to the fields of EU competition law and State aid. In addition it evaluates the relationship between the Court of Justice and the national courts through the preliminary ruling procedure and the interplay between EU law and the national procedural frameworks generally. Throughout, it takes account of significant institutional developments, including the relevant changes brought by the entry into force of the Lisbon Treaty and the amendments to the Statute of the Court of Justice of the European Union and the Rules of Procedure of the Court of Justice and the General Court.

Prácticamente un año antes se había proclamado, de forma solemne y por segunda vez, la Carta de Derechos Fundamentales de la Unión Europea. Dicho texto, que todavía no ha adquirido eficacia jurídica vinculante y que, sin embargo, sí ha sido recogido por nuestro país en la LO 1/2008, de 30 de julio, ha sido objeto de numerosos estudios. Con todo y aunque algunos de ellos son de gran calidad, es un hecho cierto que sigue sugiriendo incógnitas y que las mismas se incrementan al ponerse en relación con sus rúbricas concretas. Ni que decir tiene que los mismos se refieren tanto al acceso a los tribunales, como a la condición de parte en un proceso a desarrollar ante sus titulares y, por supuesto, a las que serían sus garantías esenciales. Esta obra camina en la dirección requerida por las instancias comunitarias y lo hace centrando su atención en esos derechos fundamentales de naturaleza procesal que son, en realidad, los que, en tanto en cuanto posibilitan su efectiva aplicación, dan vida a los demás derechos, fundamentales o no. Desde luego, es aspiración común de todos los autores que los trabajos aquí recogidos se conviertan en instrumento útil para la mayor visualización de aquellos derechos y además y sobre todo para su mejor conocimiento y aplicación. Para ello, el libro se estructura, como la propia Unión, sobre la base de tres pilares. Tres pilares que descienden desde lo general a lo particular y que, por esa razón, permiten realizar un análisis preciso, práctico y comparado del estado de la jurisprudencia de los órganos jurisdiccionales europeos de referencia.
