Book excerpt: "Tal y como se puede apreciar en el libro, quiérase o no, el Derecho actual es el Derecho Romano adaptado a la realidad de nuestro tiempo, en consideración al tenue asomo de la Ley de las XII tablas y la presencia del Corpus iuris Civilis, magno trabajo de recopilación de Derecho Romano ordenado por Justiniano, y el texto jurídico de mayor trascendencia en la historia; siendo como fue una recopilación de textos legales de época imperial, así como de jurisprudencia romana tal y como podemos observar desde los aforismos jurídicos brocárdicos latinos que se apuntan en la presente obra, tomados - casi la mayoría - de los 50 Libros del Digesto como integrante del Corpus Iuris Civilis. Obviamente que todo lo anterior puede no resultar cómodo ni pacífico, para algunos, si se observan los dos mil años aproximados desde el aparecimiento de esta extraordinaria obra jurídica. El libro no se reduce a la traducción de aforismos jurídicos latinos, sino que va más allá con la finalidad de señalar su importancia para la cultura en el mundo actual, para la doctrina, el Derecho y la Jurisprudencia. Se presenta al aforismo o brocardo jurídico trasuntando dialécticamente al Derecho actual, más aún cuando los aforismos son los Principios Generales del Derecho, que surgen como consecuencia de la experiencia procesal. Son la ratio iuris para orientar a los judicantes en la aplicación del Derecho. Los principios generales del Derecho como el origen o el fundamento de las normas, que les otorga primacía frente a las restantes fuentes del Derecho. Se fundan en el respeto a la persona humana o en la naturaleza misma de las cosas. Como se aprecia en el libro, los aforismos son de uso constante en la actividad profesional, no solo en el Derecho, sino también en la Medicina y demás ciencias del conocimiento universal, así como en el comercio que así oferta mejor sus productos. La Jurisprudencia o iura – como se apunta en el libro -, fue la producción doctrinaria sobre los principios y las instituciones del Derecho Romano, elaborada por los jurisconsultos o juristas del Periodo Clásico, en donde la iurisprudentia o Ciencia Jurídica adquirió en Roma su mayor conocimiento y brillo. La jurisprudencia - desde el principio - fue un oficio practicado por individuos con vocación y dedicación hacia el Derecho, de manera constante y no como ocupación ocasional. De esta forma, el conocimiento específico así derivado, conjuntamente con las actividades orientadas a obtener este conocimiento, se llamó iurisprudentia y a sus operadores se les conoció como iurisprudentes. ¿Qué hay de todo esto en el Derecho actual después de aproximadamente dos mil años?".

De inicio se muestra un capítulo de "introducción", con lo que se busca explicar la importancia del contenido, se detalla una "breve historia romana" alusiva a los "orígenes de la península italiana", los "pueblos que conformaron la península itálica", sobre todo los pueblos que se establecieron en la región del Lazio, (centro-sur de Italia), los etruscos, (norte-centro de Italia) y los colonizadores griegos que se establecieron en el sur de Italia, todos ellos contribuyeron al crecimiento de Roma a partir de su fundación en el siglo VIII a.C. La obra de "Rómulo y Remo", "La Monarquía", "La República, "El Imperio" (sus emperadores y su ocaso); cómo surge el "Derecho Romano", y "el uso del latín en el derecho". Con la explicación breve en cada una de las locuciones y vocablos, (de las de mayor importancia), se busca explicar el sentido de las mismas, es decir, lo que pensaron y quisieron decirnos los antiguos jurisconsultos romanos. De manera general, se muestra brevemente la historia romana, la conformación del Derecho y las locuciones con una breve explicación.
