Book excerpt: El derecho a la supresión de datos o derecho al olvido se analiza por primera vez en la sentencia del Tribunal de Justicia de la Unión Europea (Gran Sala) de 13 de mayo de 2014 (asunto C-131/12), siendo con posterioridad objeto de tratamiento en varias sentencias de la Audiencia Nacional y Tribunal Supremo, y, también, se regula por primera vez en el Reglamento (UE) 2016/679 del Parlamento europeo y del Consejo de 27 de abril de 2016 como derecho a que se supriman los datos cuando ya no resultan adecuados, pertinentes en relación con los fines para los que fueron tratados y siempre que en un juicio ponderado no prevalezcan otros derechos como el de libertad de expresión e información. Un derecho que, aunque tiene su propio campo de operatividad, se interrelaciona con otros como el de oposición, cancelación y portabilidad de los datos, y, asimismo, con los principios de calidad de los datos, finalidad y consentimiento. El presente estudio se va a centrar en el análisis de tal derecho desde su reconocimiento por el Tribunal de Justicia de la Unión Europea, Gran Sala, en sentencia de 13 de mayo de 2014, hasta su regulación en el Reglamento Europeo 2016/679, del Parlamento Europeo y del Consejo de 27 de abril de 2016 relativo a la protección de las personas físicas en lo que respecta al tratamiento de datos personales y a la libre circulación de estos datos y por el que se deroga la Directiva 95/46/CE (Reglamento General de Protección de Datos), y en la normativa nacional de protección de datos, atendiendo para ello no solamente a cómo se sustancia en tales instancias, sino también a cómo se desarrolla en el ámbito doctrinal y jurisprudencial español y, asimismo, a cómo se interrelaciona y convive con otros derechos regulados en la normativa europea y española de protección de datos, tales como el derecho a la limitación del tratamiento de los datos; el derecho a la portabilidad de los datos; el derecho de oposición del interesado; el derecho a no ser objeto de decisiones individuales automatizadas; y el derecho de rectificación.

Book excerpt: This book identifies and explains the different national approaches to data protection – the legal regulation of the collection, storage, transmission and use of information concerning identified or identifiable individuals – and determines the extent to which they could be harmonised in the foreseeable future. In recent years, data protection has become a major concern in many countries, as well as at supranational and international levels. In fact, the emergence of computing technologies that allow lower-cost processing of increasing amounts of information, associated with the advent and exponential use of the Internet and other communication networks and the widespread liberalization of the trans-border flow of information have enabled the large-scale collection and processing of personal data, not only for scientific or commercial uses, but also for political uses. A growing number of governmental and private organizations now possess and use data processing in order to determine, predict and influence individual behavior in all fields of human activity. This inevitably entails new risks, from the perspective of individual privacy, but also other fundamental rights, such as the right not to be discriminated against, fair competition between commercial enterprises and the proper functioning of democratic institutions. These phenomena have not been ignored from a legal point of view: at the national, supranational and international levels, an increasing number of regulatory instruments – including the European Union’s General Data Protection Regulation applicable as of 25 May 2018 – have been adopted with the purpose of preventing personal data misuse. Nevertheless, distinct national approaches still prevail in this domain, notably those that separate the comprehensive and detailed protective rules adopted in Europe since the 1995 Directive on the processing of personal data from the more fragmented and liberal attitude of American courts and legislators in this respect. In a globalized world, in which personal data can instantly circulate and be used simultaneously in communications networks that are ubiquitous by nature, these different national and regional approaches are a major source of legal conflict.

Book excerpt: Este trabajo surge de la idea de analizar el derecho al olvido a raíz de la aprobación del nuevo Reglamento 2016/679 del Parlamento Europeo y del Consejo de 27 de abril de 2016, que deroga la Directiva 95/46/CE (Reglamento general de protección de datos). El Reglamento regula por primera vez este derecho, que trata de establecer el equilibrio entre el derecho a la información y la autodeterminación individual.La regulación del derecho al olvido que recoge el artículo 17 del citado Reglamento reconoce el derecho a que no se realice difusión de los datos, no solo cuando dicho tratamiento no sea necesario, sino también cuando el interesado retire el consentimiento o se oponga directamente al tratamiento. Reconoce al interesado la libre disposición de sus datos sin necesidad de someterlo a condición ni justificación, por lo tanto, podrá ejercerse el derecho al olvido no solo en los casos en los que los datos estén desactualizados, sino que también se contempla este derecho para el caso en que el titular retire su consentimiento sin ser necesaria justificación ni motivación alguna.

The rights derived from Union law can be enforced in court, as opposed to other international organisations whereby enforceability is often far less certain. At the heart of the system of judicial protection in the European Union is the core principle of upholding the rule of law. As such, the stakes are high in the sense that the system of the judicial protection in the European Union must live up to its promise in which individuals, Member States and Union institutions are all guaranteed a route by which to enforce Union law rights. This book provides a rigorously structured analysis of the EU system of judicial protection and procedure before the Union courts. It examines the role and the competences of the Union courts and the types of actions that may be brought before them, such as the actions for infringement, annulment, and failure to act, as well as special forms of procedure, for example interim relief, appeals, and staff cases.
