Book excerpt: El presente Trabajo de Fin de Grado analiza los denominados reconocimientos médicos o exámenes de salud de los trabajadores, regulados principalmente en el artículo 22 de la Ley 31/1995, de 8 de noviembre, de Prevención de Riesgos Laborales. Cuyo régimen jurídico plantea numerosos problemas desde el punto de vista preventivo, pues el tenor literal no resuelve con claridad si su práctica es voluntaria u obligatoria, ni el ámbito temporal y periodicidad con la que han de llevarse a cabo. Ello sin olvidar que, la vigilancia de la salud debe realizarse respetando en todo momento el derecho a la intimidad de los trabajadores y la confidencialidad de las pruebas, para que los resultados obtenidos no resulten discriminatorios en ningún caso, pero sin dejar de redundar en el objetivo de evitar accidentes de trabajo y enfermedades profesionales.

En segundo lugar, analiza el derecho a la intimidad de los trabajadores, estudiando el nivel de protección que les da frente a su empleador. En tercer y último lugar se analizan los distintos mecanismos con los que cuentan los empresarios de hoy en día para controlar a sus trabajadores dentro y fuera del centro de trabajo, estudiando los límites de cada uno de ellos a través de la jurisprudencia.
