Book excerpt: En el presente libro se aborda el derecho a la formación profesional en el marco del contrato de trabajo. Para ello, en un primer bloque, se analiza el reconocimiento de la formación profesional como derecho individual del trabajador, sus fundamentos, funciones y utilidades, partiendo de las normas internacionales, del marco constitucional y de su configuración legal; así como la evolución de la relevancia de este derecho en el propio contexto del contrato de trabajo, sin olvidar el grado de vinculabilidad para el empresario. En un segundo bloque, se estudia, de forma minuciosa y detallada, lo que se ha denominado la dimensión positiva del derecho a la formación del trabajador en el marco de la relación laboral, lo que conlleva el análisis de todas y cada una de sus manifestaciones normativas, apoyado en la doctrina, la jurisprudencia sobre la materia, y el estudio de los convenios colectivos de diferentes sectores y ámbitos territoriales; esto permite determinar cómo queda configurado en la actualidad su contenido y qué eficacia tiene. Para finalizar, se dedica un tercer y último bloque a la dimensión negativa del citado derecho a la formación en el que se ponen de manifiesto determinadas carencias, disfuncionalidades y limitaciones de la regulación existente, a la vez que se proponen medidas destinadas a abordarlas con el fin de eliminarlas o, al menos, atenuarlas.
