Esta situación ha desbordado el ámbito de aplicación del delito de corrupción de menores, en concreto, el de captación o utilización de menores o personas con discapacidad necesitadas de especial protección con fines pornográficos o exhibicionistas, así como la elaboración de material pornográfico en el que intervienen las mismas. Esta obra pretende, desde un punto de vista eminentemente práctico (jurisprudencia y doctrina emanada desde la Fiscalía General del Estado), pero sin obviar su estudio doctrinal, ofrecer una visión penal, procesal y criminológica del delito previsto en el artículo 189.1.a) del Código Penal. La interpretación que se realice de los términos de este precepto penal nos dará como resultado un mayor o menor marco punitivo entrando en juego conceptos tales como pornografía técnica, virtual o pseudopornografía. Se analizarán, de igual modo, algunas cuestiones esenciales en la investigación y enjuiciamiento de este delito, así como la imputabilidad del pedófilo y otras cuestiones criminológicas.

Pese a que desde entonces ha transcurrido prácticamente una década, estamos ante un delito que genera muchas dudas interpretativas. Tantas que su articulado ha sido sufrido modificaciones -hasta el momento- en dos ocasiones más: mediante la Ley Orgánica 1/2015, de 30 de marzo, y la Ley Orgánica 1/2019, de 20 de febrero, respectivamente. La obra pretende dar respuesta, de esta manera, a las múltiples cuestiones que presenta la "corrupción en los negocios": desde la doble perspectiva de la responsabilidad penal de las personas físicas y jurídicas. Su objetivo es promover una interpretación restrictiva del delito, congruente con los motivos político-criminales que han dado lugar a su tipificación, y con los principios inspiradores del Derecho Penal. Pero sin perder de vista el horizonte práctico, pues la discusión central gira en torno a la determinación de las concretas conductas que prohíbe esta tipología delictiva, y de cómo afectarían las últimas reformas a la interpretación y aplicación del delito.

The expansion of new corporate criminal liability (CCL) laws since the mid-1990s challenges this assumption. Our volume surveys current practice on CCL in 15 civil and common law jurisdictions, exploring the legal conditions for liability, the principles and options for sanctioning, and the procedures for investigating, charging and trying corporate offenders. It considers whether municipal CCL laws are converging around the notion of ‘corporate culture’, and, in any case, the implications of CCL for those charged with keeping corporations, and other legal entities, out of trouble.

Focusing on the public debates over legalized sexual commerce and the spread of sexually transmitted disease in the first half of the twentieth century, Katherine Bliss argues that political change was compromised time and again by reformers' own antiquated ideas about gender and class, by prostitutes' outrage over official attempts to undermine their livelihood, and by clients' unwillingness to forgo visiting brothels despite revolutionary campaigns to promote monogamy, sexual education, and awareness of the health risks associated with sexual promiscuity. In the Mexican public's imagination, the prostitute symbolized the corruption of the old regime even as her redemption represented the new order's potential to dramatically alter gender relations through social policy. Using medical records, criminal case files, and letters from prostitutes and their patrons to public officials, Compromised Positions reveals how the contradictory revolutionary imperatives of individual freedom and public health clashed in the effort to eradicate prostitution and craft a model of morality suitable for leading Mexico into the modern era.
