Book excerpt: La puesta al día de la primera edición de este Factbook (2003) era una imperiosa necesidad cuando, tras la misma, la normativa reguladora del transporte por carretera ha variado tan sustancialmente: desde sendas modificaciones -las más de mayor relevancia habidas hasta ahora- de la Ley de Ordenación 16/1987, LOTT (que incrementa los tipos de infracciones, quizá tan exageradamente como la cuantía de las sanciones, amén de numerosas otras reformas), y de su Reglamento de aplicación de 1990, ROTT (ídem) hasta la promulgación de la Ley 15/2009 de 11 de Noviembre sobre el contrato de transporte de mercancías (de muy reciente entrada en vigor, sustituyendo en esta materia al obsoleto Código de Comercio), que incorpora gran parte de las reglas del Convenio CMR para transporte internacional, pasando por los nuevos Reglamentos europeos 1071/2009 y 1072/2009 ambos de 21 Octubre, el primero sobre condiciones para la actividad de transportista y el segundo sobre acceso al mercado de transporte internacional y “cabotaje” nacional realizado por transportistas extranjeros de la UE, así como otro medio centenar largo de otras disposiciones, de diverso rango, que directa o indirectamente afectan al ámbito del título. El lenguaje de la obra sigue siendo sencillo, asequible y ameno, sin mengua del exigible rigor jurídico en afirmaciones, argumentos y citas. A la selección de la normativa vigente se añade su ordenada y objetiva explicación -imprescindible, por la oscuridad con que demasiadas veces redacta el legislador-, jalonada de ejemplos, y, en forma que el lector puede claramente distinguir entre la exposición objetiva y el comentario, no exento de opinión, favorable o crítica, de sus prestigiosos autores. En cuanto a la estructura del Factbook, también se ha mantenido la división entre una primera parte de enfoque fundamentalmente jurídico y centrada en la materia específica del transporte y una segunda, sobre cuestiones que -algunas- pueden ser comunes a otros campos de actividad, pero de igualmente provechoso conocimiento a la empresa transportista. En fin, para seguir siendo útil también a quien ya conoció y usó su primera edición, se ha seguido un criterio más bien conservador en cuanto a los capítulos en que se divide -su denominación y su orden-, y los Índices que igualmente dan valor añadido a la obra: la división en sistemático, cronológico y analítico, y en éste último, la selección alfabética de entradas, en que se ha tenido en cuenta, no solo un criterio amplio de vocabulario contenido la normativa sino sobre todo el habitualmente utilizado -a veces, auténtica jerga- por las empresas transportistas, sus clientes los cargadores (fabricantes, comercializadores) y los receptores de las mercancías. Y ello, por cuanto en definitiva, son ellos los destinatarios del presente libro, junto a mediadores del transporte (agencias, almacenistas-distribuidores, y transitarios), aseguradores, entidades bancarias, así como docentes de la cada vez más activa y exigente formación profesional en este campo, jueces, abogados y otros profesionales del Derecho.
