Tras el estudio de la naturaleza y caracteres del contrato, se detiene en las diferencias con otras figuras afines, tarea que es sumamente importante y no exenta de dificultad, dado que el contrato de intermediación inmobiliaria es un contrato de marcada tipicidad social, pero que, aunque aparezca insólito, no esta regulado en nuestro Derecho. Como todas las figuras de tres sujetos, el contrato es complejo ya que en él se articulan los interesen contrapuestos del oferente, la contraparte y el corredor. Es aquí donde encaja el estatuto profesional del API, hoy en buena parte diluido por la liberalización, aunque persista la inscripción voluntaria en el Colegio Oficial. Aquí se tratan también varios aspectos sobre los que se han pronunciado los tribunales, tales como los deberes de información, las arras, la subcontratación, así como la Sociedad Pública de Alquileres. En lo que concierne a los elementos objetivos del contrato, se repasan a continuación con especial referencia, asimismo, a la nota de encargo, el pacto de exclusiva, el devengo de la comisión, los gastos, la protección de los adquirientes, en particular, de los consumidores en los que concierne a los tratos preliminares, la documentación del contrato y la prohibición del contrato y la prohibición de repercutir los aranceles y tributos. No se descuida, en fin, la normativa autonómica, y por eso la obra termina con la Ley de vivienda de la Comunidad Valenciana de 2004. En definitiva, es seguro que el lector encontrará en esta obra toda la información que precisa para acudir con soltura a los servicios de un API, de la misma manera que éste hallará en ellas los criterios que imperan en la práctica para resolver la mayor parte de los problemas que se presentan en el día a día de su profesión.
