Book excerpt: La obra que tiene el lector en su mano no constituye un apresurado comentario al uso, meramente exegético, de las últimas reformas sufridas por el texto original de la LO 10/1995, de 23 de noviembre, del Código penal, sino que, además de reseñar lo que ha cambiado, se señalan las implicaciones y repercusiones sistemáticas de las reformas. El propio título del libro es bien expresivo del contenido del mismo. Se trata de un conjunto de Estudios de cierto alcance sobre algunas -la mayor parte- de las modificaciones que las Leyes Orgánicas 5/2010, de 22 de junio, y 3/2011, de 28 de enero han operado en el articulado del Código penal. La reforma es amplia, pues afecta a 161 artículos (sin contar las correcciones posteriores), y profunda, pues incorpora nuevas disposiciones que tienen una especial relevancia para el conjunto del ordenamiento penal, más allá de su ámbito concreto (así, en particular, la responsabilidad de las personas jurídicas, la libertad vigilada para adultos, la atenuante por dilaciones indebidas o las nuevas formas de participación en la criminalidad organizada). Su orientación obedece a la conocida expansión del Derecho penal material y carece de una línea político-criminal clara, sin que la alusión a las obligaciones internacionales contraídas por nuestro país en el ámbito de la armonización jurídica europea pueda justificar todas las novedades que ahora aparecen en el Libro I del CP y los nuevos tipos que se contemplan en su Libro II. Como señala el Profesor Rodríguez Mourullo en el Prólogo, “Estamos, una vez más, ante una huida hacia el Derecho penal, donde el fin de prevención lo invade todo y entra en pugna con el Derecho penal garantista que tan trabajosamente se fue consolidando a lo largo del siglo pasado, amenazando con dejarlo maltrecho”. La pretensión no era, ni lo es en el libro, abarcar todos y cada uno de los distintos y múltiples aspectos que la reforma penal 2010-2011 comprende, sino la de resaltar y poner de manifiesto las novedades que han parecido más importantes o más interesantes para los llamados operadores jurídicos. En los veintinueve capítulos de la obra se abordan otros tantos ámbitos de la reforma, los que los propios autores han considerados de mayor relevancia, del texto punitivo.

It considers whether municipal CCL laws are converging around the notion of ‘corporate culture’, and, in any case, the implications of CCL for those charged with keeping corporations, and other legal entities, out of trouble.
