Por otro lado, en él se afirma contundentemente que la disponibilidad del agua "segura" o potable es un derecho humano ya que de ella dependen la calidad y nivel de vida de los seres humanos, su salud, su bienestar y su crecimiento. Siendo esta la situación, nos dice Graciela Ayala Flores: "El agua brota como el mayor conflicto geopolítico del siglo XXI, ya que se espera que en el 2025 la demanda de este elemento tan necesario para la vida humana será un 56 % superior que el suministro".

El aumento exponencial en la demanda y el carácter limitado de este recurso generan en la actualidad situaciones de superabundancia para unos y falta absoluta para otros. A medida que se agudizan las contradicciones medioambientales del actual modelo de crecimiento y se observan sus efectos sobre el clima y la naturaleza, se hace más evidente que recursos naturales como éste desempeñan una función clave para un modelo sostenible de desarrollo humano. Mientras al acceso básico al agua se le niegue la condición de derecho fundamental considerándolo una simple mercancía o una concesión discrecional de los poderes públicos, se condenará a millones de seres humanos a poner en riesgo su seguridad biológica, ambiental, económica y social. Resulta por ello imprescindible el reconocimiento universal del derecho humano al agua, como límite a los poderes privados y a los propios Estados que pretenden hacer un uso arbitrario del recurso. Más allá de las dificultades de orden material y social que rodean la satisfacción de este derecho, el presente estudio pretende reflejar la importancia de ampliar el conocimiento no sólo de las dimensiones ambientales, sociales o económicas del derecho al agua, sino también de su faceta jurídica, ofreciendo una panorámica completa de la situación actual del mismo y proponiendo algunas líneas de investigación y acción para el futuro inmediato.

Book excerpt: When privatization of public services swept the developing world in the 1990s, it was part of a seemingly unstoppable tide of neoliberal reforms aimed at reducing the role of the state and reorienting economies toward market-led policymaking. Water privatization, one of the more unpopular policies of the neoliberal development paradigm, sparked a particularly fierce debate and gave rise to a movement of self-proclaimed "water warriors" who advocated for legal recognition of water as a basic human right to be protected and fulfilled by states. Broadening the debate, Madeline Baer questions whether either approach -- the market approach or a human rights-based approach -- leads to improved access to water. More specifically, Baer explores how the human right to water and sanitation is fulfilled in different contexts, whether neoliberal policies like privatization pose a threat to the right to water, and whether rights fulfillment leads to meaningful social change. Using two case studies -- Chile, the most extreme case of water privatization in the developing world, and Bolivia, the birthplace of the global movement for the human right to water -- Stemming the Tide uncovers the conditions under which the right to water and sanitation can be fulfilled, as well as the obstacles to fulfilment. Ultimately this book argues that deepening mechanisms for citizen participation, strengthening accountability, and creating alternatives to the state/market binary can help achieve meaningful social transformation in the water sector.
