Book excerpt: In the early summer of 2005, an international expert meeting was convened in The Hague to share and compare national experiences with conciliation and mediation as methods for resolving collective labor disputes. Both the European Union and the Council of Europe have committed themselves to promoting these methods which aim to assist disputants in finding creative, negotiated solutions, while preserving their long-standing relationships. Ideally, trade unions and employers (associations) have such long-standing relationships, and many European countries have specialized conciliation officers or mediation services operating in this area. The meeting allowed leading mediators and academics to share their experiences and to exchange their views on the changes permeating Europe today: the rise of transnational labor disputes, the decentralization of collective bargaining, the process of de-unification, the joining of the EU by new member states without a social dialogue tradition, and the insights generated by the emerging science of principled bargaining, facilitative mediation, and conflict management. All these developments are likely to increase the demand for expert mediation services assisting more often less experienced negotiators. Thereby, the very nature of mediation may gradually change. This book documents the proceedings and provides a comprehensive overview of EU initiatives in the field of collective labor law and dispute resolution.

"ILLR" is intended primarily for the use of judges, labour law practitioners, industrial relations specialists and students who need or desire ready access to authoritative information of a comparative nature on problems arising in the field of labour law and industrial relations. Each judgement reprinted in "ILLR" is accompanied by Headnotes and in practically all cases by an Annotation which sets forth, among other things, the legal issues involved, the basic facts of the case (if not included in the judgement itself), the relevant statutory provisions and judicial precedents, the labour law and industrial relations context in which the case arose and the significance of the judgement in the development of the law. As a rule, judgements are printed "in extenso"; editorial discretion has been relied upon to delete or to summarize portions of judgements that are purely technical or only of marginal interest. This series unquestionably fills a void in the field of comparative labour law. Volume 18 covers the period 1 October 1997 to 30 September 1998.

The European Employment Strategy implemented in the European Union since 1997 invites social partners in all member states to participate in the promotion of employment at all levels. Is this the role of trade unions and employers organisations? Do social partners in the member states negotiate employment? Do they contribute to an objective of full employment? Do they want to improve 'employability'? Do they, finally, negotiate and reach agreements on such issues? It analyses processes of collective bargaining and agreements on employment in the fifteen member states in 2000 and 2001. Book excerpt: The insertion in June 1997 of a Title on employment in the Treaty on European Union has accelerated the drafting of European policy in this field over the last few years. This European dynamic has had widespread impact on the themes and mechanisms that characterise national systems of industrial relations. On the one hand, employment is increasingly governed by rules negotiated between the social partners and, depending on the circumstances, the State. This phenomenon of joint labour market regulation is confirmed by a marked desire on the part of employers' associations and trade unions to integrate employment-related issues into their actions and negotiations. On the other hand, the incorporation of employment-related themes by employers’ associations and trade unions, usually in concertation with government policies, is related with greater coordination of bargaining and concertation mechanisms established at European level and within each Member State. Today, the various national realities appear to be directed to various degrees by these two general tendencies. These phenomena active in the field of employment bargaining must therefore be analysed on three counts: the first focuses on the development of the coordination mechanisms that structure these negotiations, and more specifically raises the issue of co-responsibility for the labour market; the second deals with the strict content of employment bargaining, and examines the question of negotiated flexibility of working conditions and employment; the third addresses the autonomy of collective bargaining in Europe. This analysis informs our research, which is in turn intimately linked to recent changes taking place in national systems of industrial relations.

Book excerpt: One of the most neglected areas of the European integration process is the role that trade union confederations may play after the full establishment of the Economic and Monetary Union. The gradual establishment of the four freedoms enshrined in the Single European Act would require a transformation of the present strategies of trade union confederations toward more flexibility and towards the ability to take part in different levels of the European integration process. Iberian Trade Unionism highlights the emerging patterns of cooperation between national, subnational, and supranational actors and the impact on these different levels. Unlike most literature on the study of democratization and Europeanization, Iberian Trade Unionism aims to break the dominant focus on political parties and political institutions by raising awareness of the importance of interest groups such as trade union confederations in contributing to a strengthening of democratic governance. The central thesis is that both Portuguese and Spanish trade unions are becoming increasingly part of a transnational European strategy which shapes the internal organizations toward professionalism and democratization. Part 1, "Gontextualizing Iberian Trade Union Strategies," deals with the operations of both Portuguese and Spanish trade union confederations. Part 2, "The National Systems of Interest Intermediation and Trade Union Confederation Strategies," analyzes the transformation of the national systems of intermediation in the 1990s which were affected by a decline in steering power of Spanish and Portuguese political systems vis-a-vis global and European political and economic processes. Part 3, "Subnational and Transnational Policies of Iberian Trade Union Confederations," deals with policies and strategies. The last chapter treats the integration of Iberian trade union confederations in the institutions of the European Union as well as the ITUCs and is based on original research done in Madrid, Lisbon, and Brussels. This timely look at interest groups and lobbying in the European Union will appeal to scholars studying European integration and the role of interest groups in it, and to students of Spain, Portugal, or southern Europe.
