Book excerpt: En su informe, preparado de conformidad con la resolución 34/9 del Consejo de Derechos Humanos, la Relatora Especial examina la cuestión fundamental del acceso a la justicia para la defensa del derecho a la vivienda. Sugiere que la crisis mundial de la vivienda tiene sus raíces en una crisis del acceso a la justicia porque, sin ese acceso, la vivienda no se reconoce, no se entiende ni se trata adecuadamente como un derecho humano. Millones de personas sin hogar o que viven en condiciones de vida inaceptables no tienen donde acudir para reivindicar su derecho a la vivienda cuando los Estados no han logrado hacer progresivamente realidad ese derecho, han impuesto desalojos forzosos o han criminalizado a las personas sin hogar o que habitan en viviendas ilegales. La Relatora sostiene que debe ser firmemente rechazada la desfasada división del derecho a la vivienda en componentes justiciables y no justiciables, derechos negativos y positivos. Se señalan diez principios normativos clave que los Estados deben respetar para garantizar que todos los componentes del derecho a la vivienda puedan ser objeto de recursos efectivos. La Relatora Especial describe cómo se articula judicialmente el cumplimiento de la obligación de lograr progresivamente la efectividad del derecho a la vivienda; cómo evitar los desalojos forzosos y la criminalización mediante el acceso a la justicia y la participación en la toma de decisiones; cómo las instituciones nacionales de derechos humanos y los sistemas informales de justicia deben complementar el papel de los tribunales; y cómo las entidades del sector privado han de garantizar el acceso a la justicia para hacer efectivo el derecho a la vivienda.

Based on three years of research, over 100 interviews, and previously unreleased government documents, this report finds a reasonable basis to believe that government forces and members of criminal cartels have perpetrated crimes against humanity in Mexico. The report comprehensively examines why there has been so little justice for atrocity crimes, and finds the main answers in political obstruction. Given the lack of political will to end impunity, new approaches must be taken.
