A federal law, known as the McKinney-Vento Homeless Assistance Act, requires states to provide homeless children and youth with the same access to free public education as is available to other students. The Act also requires states to eliminate barriers to the enrollment, attendance or success in school of homeless students, to avoid the segregation of homeless students from the mainstream school environment and to provide access to the education and services needed to ensure that homeless students have an opportunity to meet the same challenging academic achievement standards to which all students are held. Parents and school administrators will sometimes disagree over whether a student is in fact homeless or, more frequently, where the student should be educated while homeless. As part of its obligation under the McKinney Act to ensure the education of homeless children and youth, the state of New Jersey has developed a series of procedures that are used to determine which school district should educate and transport a homeless student, and which school district should pay for the student's education and transportation. The purpose of these procedures is to ensure speedy enrollment and continuity of education, for students who are homeless. This pamphlet is designed to help parents, guardians and caregivers understand the legal concepts and procedures involved in disputes over the enrollment of homeless students in local public schools, and to inform them of their legal rights. A directory of County Superintendents, and County Offices of Education is appended. (Contains 47 endnotes.) This brief provides important information to service providers on Subtitle VII-B of the McKinney-Vento Homeless Assistance Act [42 U.S.C. ʹʹ 11431-11435], reauthorized in 2001 by Title X, Part C of the No Child Left Behind Act1 (subsequently referred to in this brief as the McKinney-Vento Act). The McKinney-Vento Act ensures educational rights and protections for homeless children and youth. This brief will enable service providers to understand: (1) which children are eligible under the definition in the law; (2) what rights and services school districts provide; (3) how the law is implemented in school districts, and (4) how community agencies and school districts can coordinate services for homeless children and youth more effectively.

This book focuses on (1) "Issues of Homelessness and Education: Causes, Consequences and Definitions"; (2) "State, Local and Federal Responsibilities Regarding Access to Education: Removing Barriers to Enrollment, Attendance and Success"; (3) "School Responsibilities and Implementation Strategies" (stability and school selection, discrimination and segregation, and identification of and outreach to families and youth experiencing homelessness); (4) "Supporting Academic Achievement: Title I, Part A Requirements"; and (5) "You Are Not Alone! Resources for Understanding and Implementing the McKinney-Vento Act." Two appendices contain a list of state coordinators for the education of homeless children and youth and statutory provisions defining the role of the U.S. Department of Education in the administration of the McKinney-Vento Act. This brief explains the key provisions in the McKinney-Vento Act concerning school enrollment, including sections on enrollment barriers, immediate enrollment, enrollment requirements, and full participation in school. Each section also offers strategies for State Coordinators, local homeless education liaisons (hereafter referred to as "local liaisons"), and school personnel to ensure that the key provisions are successfully implemented so that students experiencing homelessness are immediately enrolled in school and provided or referred to appropriate services.

McKinney Homeless Assistance Act instructs states to ensure that homeless students have equal access to the same free and appropriate public education as nonhomeless students. It provides local educational authorities increased flexibility to use funds, specify the rights of homeless preschoolers, give parents of homeless children and youth a greater voice in their children's school placement, and require educational authorities to coordinate with housing authorities. Researchers surveyed all state coordinators of education of homeless children and youth and visited school districts that did and did not receive McKinney grants. Data on four areas of state and local activity are provided: ( 1 ) 'changes in education and services to homeless children and youth under the reauthorized Act; (2) services and activities of the state Office of the Coordinator of Education of Homeless Children and Youth; (3) the McKinney Act subgrant award process, and how local education agencies with McKinney subgrants supplement services available to homeless children and youth and remove barriers to their school enrollment and success; and (4) establishment of programs and policies for homeless students in local education agencies. Recommendations of state coordinators and policy implications are included.

Many migrant workers move frequently to obtain temporary or seasonal employment in agriculture, fishing, meat processing, or dairy work, leading to high residential and school mobility for their children. With each school change, migrant students may: (1) Face difficulty enrolling in school; (2) Experience inappropriate educational placement due to lack of school records and other documentation; (3) Suffer educational disruption and loss of academic credit due to the varying curricula used in different school districts; and (4) Experience social isolation due to difficulties in adapting to new living and school environments. The cultural and linguistic diversity of many migrant children and the financial strains faced by their families, resulting from low pay and inconsistent work, further compound the potentially devastating effects on a student's education. In some instances, migrant students may experience homelessness and qualify for services provided by the McKinney-Vento Act.
