Book excerpt: Despite recent modifications, the Economic Partnership Agreement (EPA) between the European Union (EU) and West African (WA) countries is still being criticized for its potential detrimental effects on WA countries. This paper provides updated evidence on the impact of the EPA on these countries. A dynamic multicountry, multisector computable general equilibrium trade model with modeling of the dual-dual economy and with a consistent tariff aggregator is used to simulate a series of new scenarios that include updated information on the agreement. We also go beyond estimating macrolevel economic effects to analyze the impacts on poverty. The policy simulation results show that the implementation of the EPA between the EU and WA countries would have marginal but positive impacts on Burkina Faso and Côte d’Ivoire and negative impacts on Benin, Ghana, Nigeria, Senegal, and Togo. The impact on poverty indicators in Ghana and Nigeria would be marginal. From the perspective of WA countries, this study supports the view that recent EU concessions are not sufficient and that domestic fiscal reforms are needed in WA countries themselves.

Book excerpt: This thesis addresses the deadlocks in the negotiations of Economic Partnership Agreements between the EU and the African ACP states in comparison to the successful conclusion of a comprehensive CARIFORUM-EU EPA. In order to approach the topic of deadlock in multinational negotiations, two theoretical concepts from Guy Olivier Faure and Amrita Narlikar are applied. After a detailed overview of the history and state of play in the EPA negotiations, the thesis presents an exploratory research using statistical data, extensive academic literature and personal interviews with negotiators involved and experts in this particular field. The research resulted in two major findings. Firstly, the availability of superior alternatives to the EPAs is deemed to impede an efficient continuation of the negotiations. Secondly, the lack of proper negotiations institutions in the African ACPs appears to be depriving the regions of an effective way to organize and reconcile differing interests. This hinders the formulation of a common agenda to present and defend against the EU in the EPA negotiations.

Book excerpt: The EU under the auspice of the Cotonou Agreement is negotiating new trade agreements known as Economic Partnership Agreements (EPAs) with its African, Caribbean and Pacific partners (ACP). There is however a growing concern whether these free trade agreements are actually in conformity with the relevant World Trade Organisation law provisions. An analysis on the WTO compatibility of these Economic Partnership Agreements is included in this work. Further still is the controversial issue of trade and human rights; the discussion being whether human rights are relevant under trade law. This work addresses issues such as; the legal imperativeness of the right to food (as defined in the ICESCR) under the EPA and to what extent it has been incorporated in the current EU-EAC EPA framework negotiations. Most importantly also is the resultant impact such a trade agreement would have on the right to food in the East African society. With the possible violation of this right, legal redress is needed, thus a discussion on the justiciability of the human right to food is included herein.

Book excerpt: The signing of the comprehensive Economic Partnership Agreement (EPA) by the European Community (EC) and Caribbean Forum (CARIFORUM) countries covering a wide range of issues, including intellectual property (IP) provisions, has the potential to influence negotiations for other EPA groups that have only signed a series of "goods-only" interim EPAs. Even though IP is not included as one of the areas for further negotiations under the Southern African Development Community (SADC) interim EPA, there is possibility that the EC may make proposals for IP negotiations, since it is known to have a history of including IP provisions in its bilateral agreements. Generally, its approach has been to have its partners sign up to or accede to agreements containing the highest standards of IP as evidenced in the CARIFORUM EPA. This paper explores the implications for SADC EPA states of inclusion of IP provisions in the EPA in light of the probability that the EC may propose standards similar to those provisions in the innovation and IP chapter of the CARIFORUM EPA. It focuses on those provisions of the CARIFORUM EPA that may pose challenges to the SADC EPA countries and makes recommendations in the approach for possible IP negotiations for the SADC EPA countries.

Book excerpt: The Economic Partnership Agreement (EPA) signed in 2008 signalled a new era of trade relations between the European Union (EU) and the Caribbean Forum of African, Caribbean and Pacific States (CARIFORUM). Caribbean exporters previously had greater duty-free access to the EU market than European exporters enjoyed in the Caribbean, along with quotas that enabled them to avoid price competition with rivals from outside the Lomé ACP (Africa, Caribbean and Pacific) bloc. With the advent of the World Trade Organization (WTO) in 1995, the EU and the Caribbean were forced to negotiate new terms of engagement. The EPA represented a shift towards a more liberal trading regime in which greater reciprocity is the norm. Critics of the EPA believe the new trade regime will inhibit the development of new (particularly manufacturing) industries in the region and worsen the fiscal accounts of Caribbean countries. This paper, however, concludes that the aggregate negative impact of the EPA on Caribbean states will be modest, although it will likely produce challenges for smaller Caribbean governments. In particular, this paper emphasizes that the EPA will not be effective without the successful implementation and operation of the Caribbean Single Market Economy (CSME), which requires Caribbean governments to plan and coordinate economic activities together. The EPA provides the opportunity for the region to build the framework that will allow it to compete in a liberalized global economy, where a competitive environment is necessary for survival.

Book excerpt: This article provides a detailed analysis of the trade-related aspects of economic partnership agreement (EPA) negotiations for the six Africa-Caribbean-Pacific (ACP) negotiation groups including ECOWAS, CEMAC+, COMESA, SADC, CARIFORUM and Pacific. We use a partial equilibrium model--focusing on the demand side--at the HS6 level (covering 5,113 HS6 products). Two lists of sensitive products are constructed: focusing on the agricultural sectors and tariff revenue preservation. For the European Union (EU), EPAs must translate into 90% fully liberalised bilateral trade to be World Trade Organisation compatible. We use this criterion to simulate EPAs for each negotiating regional block. ACP exports to the EU are forecast to be 10% higher with EPAs, than under the generalised system of preference 'Everything But Arms' option. ACP countries, especially African ones, are forecast to lose an average of 71% of tariff revenues on EU imports in the long run. Imports from other regions of the world will continue to provide tariff revenues. Thus, if we compute tariff revenue losses on total ACP imports, losses are only 25% on average over the long run and as low as 19% if the product lists are optimised. The final impact depends on the importance of tariffs in government revenue and on potential compensatory effects. However, this long-term and less visible effect will depend mainly on the capacity of each ACP country to reorganise its fiscal base.
