Book excerpt: European farmers should have a free choice between growing conventional or organic crops or cultivating genetically modified plants instead, to the extent permissible. While this goal can hardly be disputed, it is subject to a heated - bate throughout Europe whether such co-existence can ever be truly achieved in practice, as agriculture by its nature cannot be performed in completely isolated zones which guarantee the complete segregation of GM and non-GM production. Despite all due efforts, traditional agricultural products, particul- ly if grown in the vicinity of GM fields, may therefore still turn out to contain detectable traces of GMOs. To the extent primary ways to secure the separation between the various farming practices such as buffer zones or the like fail, secondary tools may be necessary in order to reestablish the balance of interests between the prod- ers. This is where tort law and alternative redress schemes come into play. As will be seen, European jurisdictions differ quite substantially when it comes to responding to the economic loss incurred by one farmer due to the p- missible pursuit of a novel production technique applied by another. This book not only tries to present those different approaches country by country, but also offers a comparison of the existing regimes as well as reflections on how such diversity may or may not need to be addressed on a European legislative level.

Book excerpt: The debate about the use of genetically modified organisms in European agriculture is fuelled by the fear of the general public about potential risks of GM farming, whether substantiated or not. Transgenic food is suspected to cause bodily harm, have a negative impact upon the health of animals, weaken the productivity of conventional farmland, reduce biodiversity or otherwise deteriorate the environment, to name but a few dangers popping up in the public debate. Apart from setting standards for GM farming and requiring safety checks for transgenic products, all jurisdictions also provide for the case that such risks should materialize. These are not necessarily novel approaches - classic tort law already offers remedies for such losses. Sometimes these traditional solutions are enhanced or replaced by alternative redress schemes. This volume compares twenty European and four non-European jurisdictions in this respect and provides special analyses from an economic and insurance perspective as well as surveys of cross-border dispute resolution and international law.

After two decades of production, some groups and individuals remain critical of the technology based on their concerns about possible adverse effects on human health, the environment, and ethical considerations. At the same time, others are concerned that the technology is not reaching its potential to improve human health and the environment because of stringent regulations and reduced public funding to develop products offering more benefits to society. While the debate about these and other questions related to the genetic engineering techniques of the first 20 years goes on, emerging genetic-engineering technologies are adding new complexities to the conversation. Genetically Engineered Crops builds on previous related Academies reports published between 1987 and 2010 by undertaking a retrospective examination of the purported positive and adverse effects of GE crops and to anticipate what emerging genetic-engineering technologies hold for the future. This report indicates where there are uncertainties about the economic, agronomic, health, safety, or other impacts of GE crops and food, and makes recommendations to fill gaps in safety assessments, increase regulatory clarity, and improve innovations in and access to GE technology.

Book excerpt: Fifteen years after the first genetically modified (GM) seeds and food, only four GM plants have achieved significant market positions: corn, cotton, rapeseed and soybeans. Most of the other new constructs have caused unsolved problems or are only at the project stage, demonstrating the complexity of the task facing biotech companies. Doubts are also emerging about the real economic and agronomic benefits of genetically modified organisms. Little is known about their potential for upsetting environmental biodiversity in an irreversible way. Worries about their impact on human health have not been dispelled but have increased with the evident incapacity of current international standards to ensure controls and enforcement. Reliable risk assessment models and methodologies have not yet been developed and cannot be expected soon: this makes it impossible to assess the nature (qualitative aspects) and extent (quantitative aspects) of the risks, and prevents estimates based on the risk/benefit ratio. In this situation it seems prudent to resort to the precautionary principle, defined in the Cartagena Protocol and incorporated in the Rio Declaration. The stakes are high and discussion needs to be brought to a level of scientific proof that leaves no room for ambiguity or alibis. Governments, companies and scientists must be called to respond to the specific questions raised by the vast scientific literature. There have been too many accusations of poor science and too many unproven claims and statements, symptomatic of conflicts of interest. It is time for fair debate with all sides on an equal footing.

Book excerpt: "Anderson, Damania, and Jackson develop a common-agency lobbying model to help understand why North America and the European Union have adopted such different policies toward genetically modified (GM) food. Their results show that when firms (in this case farmers) lobby policymakers to influence standards, and consumers and environmentalists care about the choice of standard, it is possible that increased competition from abroad can lead to strategic incentives to raise standards, not just lower them as shown in earlier models. The authors show that differences in comparative advantage in the adoption of GM crops may be sufficient to explain the trans-Atlantic difference in GM policies. On the one hand, farmers in a country with a comparative advantage in GM technology can gain a strategic cost advantage by lobbying for lax controls on GM production and use at home and abroad. On the other hand, when faced with greater competition, the optimal response of farmers in countries with a comparative disadvantage in GM adoption may be to lobby for more-stringent GM standards. So it is rational for producers in the European Union (whose relatively small farms would enjoy less gains from the new biotechnology than broad-acre American farms) to reject GM technology if that enables them and consumer and environmental lobbyists to argue for restraints on imports from GM-adopting countries. This theoretical proposition is supported by numerical results from a global general equilibrium model of GM adoption in America with and without an EU moratorium.
