Book excerpt: Excerpt from Economic and Legal Aspects of Compulsory Proration in Agricultural Marketing The primary question which arises with reference to compulsory proration is its legality, that is, whether or not it is constitutional. It was endeavored to ascertain the probable legal status through an analysis of legislative acts and court decisions that seemed pertinent to the problem, At the same time, the economic possibilities of the plan were considered. 'this was done through a sur vey of the attempts of several groups of California producers to prorate the marketing of their crops and by summarizing some of the studies made by the Giannini Foundation of Agricultural Economics on the factors affecting the prices of specific crops. This study was made at the request of the California State Farm Bureau Federation and the California State Chamber of Commerce. 'their request was an expression of the fact that numerous farmers have reached the point where they are willing to recognize and enforce the right of the lot. This is not a new philosophy; it was manifested in the practices of the early English merchant and craft guilds. These were associations of persons enjoying a charter by public authority which endowed them with an exclusive right to practice their craft in the community. Through it the right of the lot was recognized and enforced. Since there was a narrow outlet available for the wares, each member of a guild was held to a 4stint or a prorated allotment of the common market opportunity of the guild. W/ To sell more than a specified allotment or stint was forbidden. There was also a prohibition against employing more than a specified number of journeymen and apprentices. Thus the guildsmen by means of group control made sure of a common disposal of economic opportunity. Americans, surrounded on all sides by an abundance of natural resources and expanding markets, have been slow in adopting the philosophy that the individual needs to be controlled or restrained by his fellows in the common interest and for his own protection. They have held tenaciously to a philosophy of unlimited competition. It was believed that free access to production and free competition could be relied upon to guarantee remunerative returns to producers.
