Davidson, J. - On a plea of guilty of being a loose, idle and disorderly character, the defendant was sentenced by L. W. Sicotte, Esquire, acting recorder, to six months' im prisonment. An entry on the back of the information makes it appear that the informant was examined as witness. It is objected that the conviction is bad because his evidence was not taken down in writing. By s. 856 of the Criminal Code, if the defendant admits the truth of the information and shews no sufficient cause why he should not be con victed, the justice shall convict him accordingly. The plea of guilty, whether made before or after whatever examina tion there may have been of the informant, dominates the matter. The conviction is, in terms. Based upon it alone. It is noticeable, as a matter of procedure, that neither in this case nor in the King v. J anneau, was a writ. Of habeas corpus sought for. Application for its issuance is essential to the obtainment of the discharge of a prisoner. Motion rejected. B., 1903, relating to conditional sales of chattels, and there was no written consent by either that the chattels or any of them should be afiixed to the freehold so as to become part of the realty. Neither the Adams Burns Co., nor any of the mortgagees, had any notice or knowledge of these contracts after the mortgages had been made. The property is now under the control of the liquidators, and that part of the special case is to bc considered and treated as an application by Wickes Bros. and Clark Bros. Co. to the Judge under whose direction the winding-up proceedings' are being carried on, for an order for the removal of the machinery in accordance with their contracts. It has been contended that the only efiect of sec. 1 of ch. 143, in case the contract was not filed, was td render invalid as against subsequent purchasers and mortgagees for value without notice, the condition that the title to the chattel should remain in the vendor, in which case, as to those subsequent mortgagees and purchasers, and as to them alone, the title to the chattel would pass, notwithstanding the agreement to the contrary. In all other cases the terms of the contract of sale must prevail; and, as the' vendee acquired no title until payment, he could not give any title to any one else. As respects sec. 8, it has been contended that in all cases of such conditional sales, and in the absence of any written consent to the contrary by the vendor, that section preserves to the chattel its nature and character as a chattel so long as the purchase-money remained unpaid, notwithstanding it might, in the meantime. in the ordinary and well understood course of its use and purpose, have been afiixed to the soil. and thereby, ...
