Book excerpt: Le questionnement autour de l'influence du principe de précaution sur la responsabilité juridique s'est posé, à la fois dans le discours doctrinal et dans la pratique judiciaire, au constat du renouvellement des risques de dommage qu'entraîne l'évolution technologique pour l'environnement et le vivant. Face à une demande répressive et indemnitaire croissante en provenance du corps social, la question est de savoir si le principe de précaution est à même d'engendrer un renouvellement de la responsabilité juridique, civile et pénale. Combinant une approche pluridisciplinaire et une méthode comparative, cet ouvrage se propose un double objectif. Saisir tout d'abord la portée et le contenu normatif du principe de précaution à travers l'étude de ses dynamiques normatives : circulation horizontale entre les différentes branches du droit international et circulation verticale du droit international et européen vers le droit national. Repérer ensuite les métamorphoses de la responsabilité juridique que le principe de précaution est susceptible d'engendrer à l'échelle nationale, le terme métamorphoses désignant, à l'instar des sciences du vivant, moins le résultat que les processus de transformation de la responsabilité juridique. A partir de l'analyse du processus de transformation, de changement, de façonnement de ce droit "vivant", la recherche vise à repérer, interroger et encadrer les limites de l'influence du principe de précaution sur le droit de la responsabilité, et notamment sur les sources et la mise en oeuvre de la responsabilité pénale. Dans cette perspective elle rend compte des acquis, théoriques et pratiques, dans le domaine de la responsabilité - civile et pénale - au regard de l'expérience française et comparée (Italie, Espagne, Chine et Argentine).

Cette étude a alors pour but de rendre compte de l'originalité de ce nouveau principe juridique et des rapports à la fois riches et complexes qu'il entretient avec le droit de la responsabilité civile, dont le but est, au contraire, en premier lieu indemnitaire. Dans une première partie de l'étude, Mme Boutonnet prend acte de l'émergence du principe de précaution en droit de la responsabilité civile comme principe consistant, aujourd'hui, à prévenir les dommages graves dans les domaines de l'environnement, de la santé et de la bioéthique, lorsque ces derniers atteignent certains intérêts collectifs. A ce titre, comme le montre la seconde partie de l'étude, le principe de précaution pourrait entraîner des conséquences en droit de la responsabilité civile. Au minimum, dans une finalité réparatrice, il renouvellerait l'appréciation du fait générateur, du dommage et du lien de causalité. Au maximum, il pourrait devenir un nouveau principe du droit de la responsabilité civile dont il découlerait une action préventive et collective. L'étude envisage alors la nature et le régime de cette nouvelle action en responsabilité civile, tout en démontrant que cette évolution s'effectuerait avec souplesse.

Book excerpt: This volume rethinks the work of Jacques Ellul (1912-1994) on the centenary of his birth, by presenting an overview of the current debates based on Ellul's insights. As one of the most significant twentieth-century thinkers about technology, Ellul was among the first thinkers to realize the importance of topics such as globalization, terrorism, communication technologies and ecology, and study them from a technological perspective. The book is divided into three sections. The first discusses Ellul’s diagnosis of modern society, and addresses the reception of his work on the technological society, the notion of efficiency, the process of symbolization/de-symbolization, and ecology. The second analyzes communicational and cultural problems, as well as threats and trends in early twenty-first century societies. Many of the issues Ellul saw as crucial – such as energy, propaganda, applied life sciences and communication – continue to be so. In fact they have grown exponentially, on a global scale, producing new forms of risk. Essays in the final section examine the duality of reason and revelation. They pursue an understanding of Ellul in terms of the depth of experience and the traditions of human knowledge, which is to say, on the one hand, the experience of the human being as contained in the rationalist, sociological and philosophical traditions. On the other hand there are the transcendent roots of human existence, as well as “revealed knowledge,” in the mystical and religious traditions. The meeting of these two traditions enables us to look at Ellul’s work as a whole, but above all it opens up a space for examining religious life in the technological society.
