Book excerpt: The process through which European States and institutions have responded to the social and cultural mutation in the European religious landscape has been met with increasing criticism. Depending upon the interests and the agendas at stake, European instances have been blamed for being too weak or too strong in their policies affecting religion, for being biased either in favor or against religion and ultimately for an insufficient commitment to worldwide religious liberty. This paper aims at responding to criticism through a three-step approach. First, it will highlight the peculiarity and salience of developments in European law and religion, based on the four projects that drove the interaction of law and religion in the European integration process: the human rights project, the single market project, the secular project and the religious project. In this part, I will suggest that, prior to any discussion on the direction that Europeans should take in the future, it is necessary to acknowledge Europe as an extraordinary laboratory of equality and diversity, allowing for an extremely dynamic interaction of law and religion to develop. Second, the paper will underline the concoction of human rights and single market in the making of European dynamic law and religion, and will study the implications thereof. Third, the paper will point at the emergence of a threefold pattern of clashing forces and ideas: the secular versus the religious; States versus Europe; and majorities versus minorities. I will observe that a defensive strategy has fuelled the threefold divisive pattern, consecrating a paradigm increasingly at odds with the dramatically changed picture of beliefs and convictions in Europe, I will argue that the disconnection between the old, dominant paradigm and the various European realities, means that a new paradigm is badly needed. I will conclude that Europe needs the courage to honor its inclination towards a dynamic, constantly evolving interaction of law and religion. This will imply acknowledging change as a key feature of the European experience with law and religion, and, once again, 'choosing change' in order to enhance religious pluralism, reassess the role of the State as the 'neutral and impartial organizer of the practising of the various religions, denominations and beliefs,' (European Court of Human Rights, 2001) assert the European Union as 'impartial' and 'not aligned with any specific religion or belief' (EU Guidelines on the protection and promotion of freedom of religion or belief, 2013), and encourage actors involved in religion and belief to reinvent structures and actions.

This book provides a detailed comparative introduction to these laws with particular reference to the states of the European Union. A comparison of national laws on religion reveals profound similarities between them. From these emerge principles of law on religion common to the states of Europe and the book articulates these for the first time. It examines the constitutional postures of states towards religion, religious freedom, and discrimination, and the legal position, autonomy, and ministers of religious organizations. It also examines the protection of doctrine and worship, the property and finances of religion, religion, education, and public institutions, and religion, marriage, and children, as well as the fundamentals of the emergent European Union law on religion. The existence of these principles challenges the standard view in modern scholarship that there is little commonality in the legal postures of European states towards religion - it reveals that the dominant juridical model in Europe is that of cooperation between State and religion. The book also analyses national laws in the context of international laws on religion, particularly the European Convention on Human Rights. It proposes that national laws go further than these in their treatment and protection of religion, and that the principles of religion law common to the states of Europe may themselves represent a blueprint for the development of international norms in this field. The book provides a wealth of legal materials for scholars and students. The principles articulated in it also enable greater dialogue between law and disciplines beyond law, such as the sociology of religion, about the role of religion in Europe today. The book also identifies areas for further research in this regard, pointing the direction for future study.

The latter group is primarily based on the variety of sacred cultural elements emanating from the different religious traditions of the peoples of Europe, which are deemed worthy of protection and preservation due to their outstanding value, in terms of their social, cultural and religious significance. In view of this, the study provides evidence of the European States’ active involvement with their sacred/cultural treasures, on the basis of the political and legal foundations of neutrality and pluralism. Furthermore, the book analyzes all relevant international legislative instruments (i.e. the plethora of EU, EC and UNESCO norms), as well as all major European legislative patterns, in light of their significance for the aforementioned aspects of pluralism and neutrality. The interdisciplinary references listed at the end of each chapter provide an additional incentive for further reading on the subject matter. The most important finding to emerge from the study is that there is a shared legal ethos in Europe that imposes a duty of appropriate care concerning the vast variety of sacred cultural goods and the religious cultural heritage in general, as an invaluable repository of European cultural capital. It also considers the sui generis nature of this capital: like any other type of asset, it may deteriorate or fade over time, necessitating investment in its preservation or refurbishment; nevertheless, like no other, this particular capital maintains a distinct cultural value, as it contains an additional characteristic of ‘sacredness’ expressed in the form of its ‘religious character,’ the latter being analyzed as a triptych of religious memory, religious aesthetics and religious beliefs.

He examines the facilitation and protection of individual and institutional religious freedom in EU law and the means through which the Union facilitates religious input and influence over law. Identifying the limitations on religious influence over law and politics that have been required by the Union, it demonstrates how such limitations have been identified as fundamental elements of the public order and prerequisites EU membership. The Union seeks to balance its predominantly Christian religious heritage with an equally strong secular and humanist by facilitating religion as a form of cultural identity while simultaneously limiting its political influence. Such balancing takes place in the context of the Union's limited legitimacy and its commitment to respect for Member State cultural autonomy. Deference towards the cultural role of religion at Member State level enables culturally-entrenched religions to exercise a greater degree of influence within the Union's public order than "outsider" faiths that lack a comparable cultural role. Placing the Union's approach to religion in the context of broader historical and sociological trends around religion in Europe and of contemporary debates around secularism, equal treatment, and the role of Islam in Europe, McCrea sheds light on the interaction between religion and EU law in the face of a shifting religious demographic.
