L’objectif du présent ouvrage est notamment de fournir des éclaircissements sur la signification de cette qualification. Après avoir circonscrit les contours de la notion de régime spécial en droit international, l’ouvrage s’interroge sur les éventuelles spécificités du droit international humanitaire tant par rapport au « système général », c’est-à-dire aux règles secondaires du droit international général, que par rapport à d’autres « sous-systèmes », tels que le droit international pénal, les droits de l’homme ou le droit international de l’environnement. Cette analyse entend cerner au mieux les rapports existant entre le droit international humanitaire et les autres systèmes – général ou spéciaux – de droit international et se prononcer ainsi sur la question sous-jacente de l’ «autonomisation» de ce droit. Elle montre que, loin de produire une «cacophonie» au sein de l’ordre juridique international, cet enchevêtrement de différents systèmes relevant de cet ordre s’apparente le plus souvent à une «polyphonie» harmonieuse.

Il sera donc question de bâtir notre développement autour de cette interrogation fondamentale. La vérification et la clarification de cette question fondamentale, commandent sans doute que l’on envisage une hypothèse de recherche dans cette réflexion. La question de la protection des droits de l’homme dans les opérations de maintien de la paix est relativement récente. Elle se rattache en réalité, à la problématique générale de la protection des droits de l’homme à l’échelle internationale. En effet, la question des droits de l’homme reste au centre de toute réflexion sur la condition humaine et l’avenir du monde. C’est ainsi qu’au lendemain de la seconde guerre mondiale, on assiste à un sursaut de conscience planétaire devant les désastres des conflits. Aussi est-il important de relever que la communauté internationale des Etats dans son ensemble commence à discourir sur la condition humaine. Par ailleurs, si la fin de « la guerre froide » a permis, à certains égards de revenir à une mise en œuvre de la Charte plus proche du dessein original de ses rédacteurs, l’élément fondamental de cette évolution réside dans l’acceptation des droits de l’homme comme un des piliers de la sécurité collective, et puis l’intégration desdits droits comme composantes essentielles des opérations de maintien de la paix. La liaison établie par le Conseil de sécurité entre menace à la paix et violation des droits de l’homme a permis d’introduire la dimension humanitaire, pourtant déjà présente dans la Charte des Nations Unies, au cœur même du Chapitre VII de la Charte. Toute cette évolution a amplifié la prise en compte des droits de l’homme dans la mise en œuvre des mandats des opérations de maintien de la paix. Sans doute, la pratique n’est pas encore très cohérente, mais l’enseignement est révélateur.

Consequently, the jurisprudence of the European Court of Human Rights (ECtHR) concerning substantive individual labour rights, or ‘rights at work’, is coming to greater prominence at the national level throughout the forty-seven Member States of the Council of Europe. This is the first book in English to provide a thorough analysis of the Court’s most recent case law – cases considered in the period from 1963 to 2016 – on fundamental employment rights such as the right to wages, protection from discrimination and unfair dismissal, the right to occupational safety at work, and civil liberties such as the freedom of association, the freedom of religion and expression, and the right to privacy. Drawing on close scrutiny of 347 cases since 1963, the author traces the evolutionary development of the Court’s positions on labour rights as human rights through case analyses, commentary, and general conclusions in each of several categorical groupings. Recent trends are treated in substantial detail.
