Il y a d’abord collision – c’est le moment de l’impact – lorsque la question nucléaire entre en contact avec le droit public. Les logiques alors se télescopent. Des acteurs et des pouvoirs apparaissent. Des sources internationales, européennes et nationales s’organisent. Il y a ensuite fusion – par un phénomène de réception continue – lorsque les matières de droit public sont confrontées aux problématiques du nucléaire. Le contrôle des juges administratifs et de l’Union européenne ainsi que le diptyque responsabilité/réparation sont alors des questions qui ne peuvent être laissées sans réponse. Une telle confrontation entre « Droit public et nucléaire » est un projet ambitieux et novateur. Pour le mener à bien, une équipe de vingt-sept auteurs – universitaires, magistrats, praticiens du droit – a été constituée sous la direction scientifique d’Olivier Guézou et Stéphane Manson, et sous les auspices du Laboratoire de recherche « Versailles Saint-Quentin Institutions Publiques » (EA n° 3643 – laboratoire de droit public de l’Université de Versailles Saint-Quentin-en-Yvelines). Le présent ouvrage est le résultat de cette recherche qui se poursuit également à travers un colloque organisé au Conseil d’Etat en mars 2013.

Autour de cette position, un vif débat à la fois juridique et éthique a été soulevé. En effet, pour ses opposants, le nucléaire représente un risque durable et non maîtrisable par la science. Les accidents nucléaires majeurs, les déchets radioactifs et le détournement du nucléaire à des fins militaires sont des risques ingérables et d"une gravité exceptionnelle. En revanche, les défenseurs de cette énergie la présentent comme sûre, voire partie prenante du développement durable. Selon eux, le nucléaire est un moyen fiable de lutter contre le réchauffement climatique et aussi une solution à la pénurie énergétique à laquelle le monde est confronté. En examinant et analysant la fiabilité et la crédibilité de tous les arguments allant à l"encontre et en faveur de cette industrie, on constate que la licéité et la légitimité du recours à l'énergie nucléaire sont mal fondées. Par conséquent, nous estimons qu"il est nécessaire de dépasser le nucléaire par la conclusion d'une convention internationale posant l'interdiction progressive mais complète du nucléaire.

Cette dimension existentielle amène à s'interroger sur la pertinence de l'inscrire dans la Constitution. S'il se constate une coutume de l'exécutif, l'arme nucléaire française participe au fonctionnement des pouvoirs publics sans pour autant être une norme. Dépasser cette contrainte nécessiterait de systémiser en droit constitutionnel l'arme nucléaire en revenant à son concept originel de « force de frappe ». Actualisant sa définition juridique, cet ouvrage propose de constitutionnaliser la force de frappe, afin de consacrer la valeur constitutionnelle de l'arme nucléaire au titre de l'indépendance nationale.

Book excerpt: Textbooks on international law, dicta of the International Court of Justice and the International Law Commission's 'Guiding Principles applicable to unilateral declarations of states capable of creating legal obligations' of 2006, all reflect the fact that in international law a state's unilateral declaration can create a legally binding obligation. Unilateral declarations are common, as a look at the weekly headlines of any major newspaper will reveal. Many of the declarations made at the highest level are, of course, vaguely expressed and carry no tangible legal commitment. But others deliver a very clear message: for instance the US's April 2010 declaration on its future use of nuclear weapons or Kosovo's declaration of independence and pledge to follow the Ahtisaari Plan, are two recent and prominent examples of unilateral declarations at the international level. The same sources, however, also reveal that while state promises are accepted as a means for states to create full blown legal commitments, the law governing such declarations is far from clear. This monograph fills a gap in international legal scholarship by raising and answering the question of the precise legal value of such pledges in the realm of public international law. After a brief introduction state promises in international law are defined and contrasted with other unilateral acts of states, and the history of promises in state practice and court decisions is delineated, together with scholarly opinion. The book then provides a detailed picture of the international legal framework governing promises of states, and ends with a brief assessment of the raison d'être for promises as a binding mechanism in international law, along with their advantages and disadvantages in comparison with the classical mechanism for assuming international obligations - the international treaty. This is currently the only book to present a comprehensive overview of the legal effect of promises by states in international law.
