Le droit patrimonial de la famille et le droit des entreprises en difficulté présentent alors une identité d'objet : le patrimoine de l'entrepreneur. Dès lors l'application de ces deux disciplines sur une même masse de biens peut se révéler conflictuelle. Après avoir déterminé l'étendue du gage des créanciers, il est étudié l'exercice de leur doit de poursuite pour démontrer l'adoption de solutions diamétralement opposées que le droit des entreprises en difficulté se borne à appliquer. Il s'agit alors de relever les difficultés qui en découlent. Il est ensuite proposé un réaménagement du patrimoine de l'entrepreneur individuel, à partir de l'étude des concepts de pouvoir et d'universalité juridique, suggérant ainsi la restauration bilatéralisée des biens communs réservés et la reconnaissance d'un statut à l'entreprise individuelle.
