By 1789, to be sure, England looked proudly back to the Magna Carta, the Petition of Right, and a bill of rights, and even the young American Declaration of Independence and the individual states’ various declarations and bills of rights preceded the French Declaration. But the French deputies of the National Assembly tried hard, in the words of one of their number, not to receive lessons from others but rather “to give them” to the rest of the world, to proclaim not the rights of Frenchmen, but those “for all times and nations.” The chapters in this book treat mainly the origins of the Declaration in the political thought and practice of the preceding three centuries that Tocqueville designated the “Old Regime.” Among the topics covered are privileged corporations; the events of the three months preceding the Declaration; blacks, Jews, and women; the Assembly’s debates on the Declaration; the influence of sixteenth-century notions of sovereignty and the separation of powers; the rights of the accused in legal practices and political trials from 1716 to 1789; the natural rights to freedom of religion; and the monarchy’s “feudal” exploitation of the royal domain.

In Reason and Fairness Ulrike Müßig reveals the combination of ordinary judicial competences with procedural rationality, together with the complementarity of procedural and substantive justice, as the foundation for the ‘rule of law’ in court constitution, far earlier than the advent of liberal constitutionalism. The ECHR fair trial guarantee reads as the historically-grown consensus of the functional judicial independence. Both before historical and contemporary courts, justice is done and seen to be done by means of judgements, whose legal requirements combine the equation of ‘fair’ and ‘legal’ with that of ‘legal’ and ‘rational.’ This legal determinability of the judge’s fair attitude amounts to the specific (rational) European idea of justice.

Nor does the premise that organisms defend themselves at the cellular or molecular levels. For nearly two thousand years “immunity,” a legal concept invented in ancient Rome, serves almost exclusively political and juridical ends. “Self-defense” also originates in a juridico-political context; it emerges in the mid-seventeenth century, during the English Civil War, when Thomas Hobbes defines it as the first “natural right.” In the 1880s and 1890s, biomedicine fuses these two political precepts into one, creating a new vital function, “immunity-as-defense.” In A Body Worth Defending, Ed Cohen reveals the unacknowledged political, economic, and philosophical assumptions about the human body that biomedicine incorporates when it recruits immunity to safeguard the vulnerable living organism. Inspired by Michel Foucault’s writings about biopolitics and biopower, Cohen traces the migration of immunity from politics and law into the domains of medicine and science. Offering a genealogy of the concept, he illuminates a complex of thinking about modern bodies that percolates through European political, legal, philosophical, economic, governmental, scientific, and medical discourses from the mid-seventeenth century through the twentieth. He shows that by the late nineteenth century, “the body” literally incarnates modern notions of personhood. In this lively cultural rumination, Cohen argues that by embracing the idea of immunity-as-defense so exclusively, biomedicine naturalizes the individual as the privileged focus for identifying and treating illness, thereby devaluing or obscuring approaches to healing situated within communities or collectives.

Universality is thus no longer deduced by something that is objectively given, within the shared praxis. Conversely, what seems to have to be universal is what we want to be valid for everyone. Citizen Subject is the summation of Étienne Balibar’s career-long project to think the necessary and necessarily antagonistic relation between the categories of citizen and subject. In this magnum opus, the question of modernity is framed anew with special attention to the self-enunciation of the subject (in Descartes, Locke, Rousseau, and Derrida), the constitution of the community as “we” (in Hegel, Marx, and Tolstoy), and the aporia of the judgment of self and others (in Foucualt, Freud, Kelsen, and Blanchot). After the “humanist controversy” that preoccupied twentieth-century philosophy, Citizen Subject proposes foundations for philosophical anthropology today, in terms of two contrary movements: the becoming-citizen of the subject and the becoming-subject of the citizen. The citizen-subject who is constituted in the claim to a “right to have rights” (Arendt) cannot exist without an underside that contests and defies it. He—or she, because Balibar is concerned throughout this volume with questions of sexual difference—figures not only the social relation but also the discontent or the uneasiness at the heart of this relation. The human can be instituted only if it betrays itself by upholding “anthropological differences” that impose normality and identity as conditions of belonging to the community. The violence of “civil” bourgeois universality, Balibar argues, is greater (and less legitimate, therefore less stable) than that of theological or cosmological universality. Right is thus founded on insubordination, and emancipation derives its force from otherness. Ultimately, Citizen Subject offers a revolutionary rewriting of the dialectic of universality and differences in the bourgeois epoch, revealing in the relationship between the common and the universal a political gap at the heart of the universal itself.
