Le droit de la responsabilité civile est donc traité de manière approfondie, intégrant notamment la problématique des infections nosocomiales, de la naissance d'un enfant non désiré, des conséquences dommageables des vaccinations ou encore de la recherche sur l'être humain. Le volet pénal de ces responsabilités n'est pas oublié. Il est essentiellement axé sur les dispositions relatives à la violation du secret et sur la problématique des faux certificats. La déontologie et le droit disciplinaire de la LPMéd sont analysés, présentant nombre de situations auxquelles les médecins peuvent être confrontés et les conséquences de leurs actes. Enfin, le dossier médical, sa constitution, son contenu et les obligations qui y sont liées font, comme les biobanques, l'objet d'une large présentation.

En effet, il n'est pas envisageable d'aborder cette matière sans réserver une place aux fondements constitutionnels du droit médical, dès lors que les dernières décennies ont vu l'émergence d'un véritable corpus constitutionnel du droit de la santé. La présentation des dispositions constitutionnelles régissant ce domaine est complétée par celle des principales lois édictées en application de ces normes: LPméd, LPSan, LAMal, LRH, LPMA, LEp, LRCS, loi sur la transplantation, LDEP etc. La relation avec le droit cantonal n'est bien entendu nullement ignorée. Le droit interne n'est toutefois, tant s'en faut, le seul à régir cette matière. Le droit international joue, au travers des traités impératifs – CEDH, Convention d'Oviedo – un rôle moteur extrêmement important, complété qu'il est par une multitude de textes relevant de la soft law. Principe directeur de l'activité étatique, le respect de la dignité humaine, du début à la fin de la vie, crée le pont incontesté entre le droit et l'éthique dont les principes sont essentiels pour la bonne compréhension du monde des soins. Bienfaisance, non-malfaisance, autonomie et justice encadrent en effet toutes les activités médicales. Exprimés dans des textes associatifs (ASSM, Association Médicale Mondiale), par des autorités spécialisées (CNE, CCNE) ou dans des documents issus des institutions internationales, ces principes donnent souvent une consistance aux dispositions légales par définition générales et abstraites. La jurisprudence ne l'ignore pas... Enfin, le monde médical est aussi celui de la technique: les règles de l'art, les bonnes pratiques et l'EBM sont alors les mots-clés.
