Si certaines inquiétudes demeurent, l’essentiel est d’affirmer que chacun a la maîtrise de son propre corps, tout en balisant cette prérogative d’indispensables limites juridiques et éthiques. Le droit (bio)médical contemporain combine ainsi l’autonomie de la personne et la protection dont elle doit bénéficier. Le législateur belge a notamment fait œuvre courageuse et humaniste en concevant la fin de vie sous l’angle de l’autodétermination du malade, plutôt qu’à l’aune des obligations du médecin. Parallèlement, plusieurs interventions de la Cour de cassation ont contribué à clarifier le paysage de la responsabilité médicale, qu’il y aura lieu d’articuler, à l’avenir, avec le nouveau régime plus objectif d’indemnisation des accidents médicaux. L’ouvrage dresse un panorama complet du droit médical et biomédical belge actuel : aspects juridiques de la relation entre médecins et patients, responsabilité médicale et réglementation de diverses interventions corporelles, de la naissance à la mort. Les règles et le raisonnement juridiques qu’il décrit, inspirés par une vision moderne et tolérante, rendent la personne maître de son corps et de son destin, suffisamment protégée contre les abus et toujours libre de ses choix.

Par ailleurs, les autorités institutionnelles sanitaires et les acteurs de la relation médicale sont également à l'origine de la production des normes de droit souple, a priori sans valeur coercitive, que le droit va faire sienne et intégrer à la norme juridique. L'étude du droit médical démontre, en résumé, une ambivalence de la matière à l'égard des influences exercées par les acteurs du système de santé sur la pratique de la médecine et sur les sources des normes qui l'encadre.

Medical devices and medical technology are used to create or support many different products and medical-surgical procedures. This volume on the regulation of medical devices in the European Union, with a focus on France, tackles a topic of interdisciplinary interest and significance for policymakers in countries around the globe. The EU regulatory regime is one of three global regional regimes, and medical products manufactured in EU countries are sold worldwide. As countries confront an aging population on a global scale, with associated increases in chronic diseases, physical handicaps, and multi-morbidity, there will inevitably be an increase in the demand for health services and, concomitantly, the use of medical devices in medical and surgical procedures.
