The papers deal with the influence of the Code upon common-law countries in their efforts to manage statute and case law and gives examples of modern attempts at restatement of the law and uniform state laws as examples of the effect of the Code's coherence and logic. The papers were given by notable legal scholars such as Benjamin Akzin, Ren Cassin, C.J. Friedrich, Arthur von Mehren, Roscoe Pound, Thibadeau Rinfret, Max Rheinstein, Angelo Piero Sereni, Jack Bernard Tate and Arthur T. Vanderbilt. At the time of these lectures Schwartz was Director of the Institute. Includes a bibliography by Julius J. Marke. Reprint of the first edition. BERNARD SCHWARTZ 1923-1997] was professor of law and director of the Institute of Comparative Law, New York University. He was the author of over fifty books, including French Administrative Law and the Common-Law World (1954, reprinted 2006), the five-volume Commentary on the Constitution of the United States (1963-1968), Constitutional Law: A Textbook (2d ed., 1979), Administrative Law: A Casebook (4th ed., 1994) and A History of the Supreme Court (1993).

At the same time, it created fundamental contradictions between citizenship and family as women acquired new rights and duties but remained dependents within the household. In The Family and the Nation, Jennifer Ngaire Heuer examines the meaning of citizenship during and after the revolution and the relationship between citizenship and gender as these ideas and practices were reworked in the late 1790s and early nineteenth century.Heuer argues that tensions between family and nation shaped men's and women's legal and social identities from the Revolution and Terror through the Restoration. She shows the critical importance of relating nationality to political citizenship and of examining the application, not just the creation, of new categories of membership in the nation. Heuer draws on diverse historical sources—from political treatises to police records, immigration reports to court cases—to demonstrate the extent of revolutionary concern over national citizenship. This book casts into relief France's evolving attitudes toward patriotism, immigration, and emigration, and the frequently opposing demands of family ties and citizenship.

It defines judicial effectiveness as composed of three main components, namely the length, cost and predictability of proceedings. Following a comprehensive review of the relevant case law, the book argues that the legal standards established by the Court in these areas are rather modest, and that the legal reasoning behind them is predominantly formalist. Rather than developing an understanding of the relevant policy choices that determine the institutional framework of civil justice, the Court bases its decisions on abstract concepts like 'reasonable time', 'access to court' and 'legal certainty'. By sidelining the key institutional issues such as resource allocation and incentives, the Court has produced a largely theoretical case law that actually has little value for persons who wish to enforce their rights in courts.
