Il bénéficie des faveurs, notamment étatiques, en raison du formalisme qui entoure sa conclusion : acte écrit, consentement exprès à l’acte. Les Etats y voient le mode le plus sûr - au sens de la détermination ou de la sécurité juridiques - de l’engagement international. Entendu de manière classique comme un acte juridique, le traité international est passible d’une analyse en termes de mode de production du droit et de produit. Cette dichotomie essentielle permet de pointer à la fois la richesse considérable du résultat de l’opération conventionnelle, qui ne se réduit notamment pas aux énoncés normatifs, et le caractère indéterminé du mode de production , l’opération conventionnelle n’ayant pas à satisfaire à quelque condition autre que le respect de la volonté des auteurs de l’acte. En effet, si la Convention de Vienne du 23 mai 1969, portant pour l’essentiel codification du régime coutumier, propose définition et réglementation qui semblent présenter les caractères de cohérence et de systématisation, l’ensemble repose sur un principe, qui déborde par ailleurs le strict cadre du traité, et peut se ramasser en une formule : l’autonomie de la volonté des sujets souverains. Il en résulte que le traité ne constitue que l’une des figures possibles de l’engagement, que rien ne vient distinguer efficacement d’autres modes consacrés par le droit international.
