Book excerpt: The "African Yearbook of International Law" provides an intellectual forum for the systematic analysis and scientific dissection of issues of international law as they apply to Africa, as well as Africa's contribution to the progressive development of international law. It contributes to the promotion, acceptance of and respect for the principles of international law, as well as to the encouragement of the teaching, study, dissemination and wider appreciations of international law in Africa. A clear articulation of Africa's views on the various aspects of international law based on the present realities of the continent as well as on Africa's civilization, culture, philosophy and history will undoubtedly contribute to a better understanding among nations. The "African Yearbook of International Law" plays an important role in examining the tensions underlying the State in Africa, and by shedding more light on the causes of the fragility of African State institutions so as to facilitate the identification of appropriate remedies. The tension and interrelationships among issues such as territorial integrity, self determination, ethnic diversity and nation-building are constantly addressed. Development, human rights and democratization in Africa are also the subject of continuous attention and examination. The "Special Theme" of this volume is "Regional Economic Integration in Africa II,"

This book was released on 1995-01-01 with total page 328 pages. Available in PDF, EPUB and Kindle. Book excerpt: Founded in 1993, the African Yearbook, now published under the auspices of the African Foundation for International Law, is the only scholarly publication devoted exclusively to the study, development, dissemination and wider appreciation of international law in Africa as a whole. Through the scholarly analysis of international legal issues of particular relevance to the African continent, it also contributes to the acceptance of, and respect for the rule of law in intra-African relations, and for the principles of international law in general. Its uniqueness however goes beyond this, for through its special themes and general articles, it has succeeded over the years to serve as an intellectual forum where the development of international law is viewed as being integral to Africa's own development. Through the study and analysis of emerging legal issues of particular relevance to Africa, such as the creation of viable continental institutions capable of promoting unity and security for the peoples of the continent, the effective protection of human rights, the need for accountability for mass killings and massive violations of the rule of law, the promotion of a rule-based democratic culture, the role of African countries in a globalizing world economy and in international trade relations, the Yearbook strives to be responsive to the intellectual needs of African countries in the area of international law, andtothe continuing struggle for creating an environment conducive to the rule of law throughout the continent. The Yearbook also provides ready access to the basic documents of African international organizations by regularly publishing the resolutions and decisions ofregional and sub-regional organizations as well as the conventions, protocols and declarations adopted by pan-african agencies. Book excerpt: In African Basin Management Organizations - Contribution to Pollution Prevention of Transboundary Water Resources, Komlan Sangbana highlights how the protection of water resources and their ecosystems has become a key focus of basin organizations in Africa. The development, adoption and implementation of pollution control standards by basin organizations have widened the remit and greatly strengthened the role of these institutions. As such, basin organizations have become central actors in the domain of African regional law for the protection of freshwater resources. This monograph analyses the variety of functions and tasks that have been entrusted to African basin organizations to prevent pollution damage and provides some avenues for strengthening the work they perform to protect river systems.
Download or read book Evolving Constitutions of International Organizations written by Sato and published by Martinus Nijhoff Publishers. This book was released on 2023-09-14 with total page 320 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book analyzes the law-creating process relating to the interpretation of constituent instruments of international organizations. This topic is one of the key issues concerning the structures and activities of international organizations. It differs from other books in the field by suggesting that, under the influences of the inherent dynamism of international organizations, the interpretative framework of their constituent instruments is not the same as that of ordinary treaties. It also concludes that the interpretation of the constituent instruments of international organizations deviates from the interpretative framework regulated by the law of treaties as codified by the Vienna Convention on the Law of Treaties. The book will be of prime interest to academics in the fields of international law and international organization and treaty law.

Download or read book The Southern African Development Community Treaty Nexus written by Korwa Gombe Adar and published by Rowman & Littlefield. This book was released on 2023-03-27 with total page 289 pages. Available in PDF, EPUB and Kindle. Book excerpt: Since its establishment in 1980 the Southern African Development Community (SADC) has largely been a state driven organization, with the people of Southern Africa, though enshrined in the treaty, remaining observers in the SADC democratization and integration agenda. The Southern African Development Community Treaty-Nexus: National Constitutions, Citizen’s Sovereignty, Communication, and Awareness, edited by Korwa Gombe Adar, Dorothy Mpabanga, Kebapetse Lotshwao, Thekiso Molokwane, and Norbert Musekiwa, brings in the people of Southern Africa, the key beneficiaries of the integration agenda, in the SADC democratization and integration epistemology. Using the new concepts of sadcness and sadcnization, this book operationalizes from legal, communication, and awareness perspectives, the nexus of the people of Southern Africa, democratization, and integration in the SADC region. From legal and communications lenses, the contributors argue that democratization and integration are about people (citizens), the sovereigns, and not merely the abstract actors called nation states. Using the case studies of Angola, Botswana, Madagascar, Mozambique, South Africa, and Zimbabwe, the contributors engage in this epistemology and assess, among other things, the peoples' of Southern Africa—the Southern Africa Development Community integration nexus.

Available in PDF, EPUB and Kindle. Book excerpt: The arrival of the International Law: Achievements and Prospects can fairly be described as a major event in international legal publishing. It has been written by international lawyers from the North, the South, the East and the West, whose differing origins and different, or even opposed, academic backgrounds have ensured that the book encapsulates and brings into focus `the main forms of civilization' and `the principal legal systems of the world'. The book's most distinctive feature is its international, multi-cultural and polyphonic nature. International Law: Achievements and Prospects aims to inform and to educate, to make the discipline of international law accessible to a very broad public, and to promote a meeting of minds on fundamental notions, key concepts, and the guiding principles of international law, over and beyond frontiers, ideologies and doctrines. In addition, it is intended to provide a framework for thought, to describe what international law is today, to specify its nature, define its purpose and show its strengths, and also to point out its weaknesses. All the contributing authors are or have been practitioners of international law. Their contributions express a global view of international law which helps to unravel the complex reality of the contemporary world. International Law: Achievements and Prospects has been produced under the auspices of UNESCO; its content also aspires to reflect, in some measure, the imprint of that Organization's sponsorship.
