A cette fin, on s'est d'abord pose la question de l'existence du droit de la consommation face à la théorie générale du contrat. Pour exister, le droit de la consommation doit se présenter comme une branche de droit véritable, c'est-à-dire comme un " ensemble ", par opposition au " rassemblement ". Alors que le " rassemblement " est une simple réunion de dispositions animées par une fin commune, " l'ensemble " se caractérise par l'union de ces normes en un tout. Il y a ensemble lorsque le regroupement est doté de critères d'application objectifs et d'un droit commun propre. Appliquée au droit de la consommation, cette distinction n'a permis de conclure qu'à l'existence d'un " rassemblement ". Cette conclusion est déterminante des rapports que le droit spécial entretient avec la théorie générale du contrat. Parce qu'il n'est pas un droit véritable, les juges sont obligés de recourir au droit des contrats lorsqu'il s'agit de compléter le droit spécial ou de le préciser

Book excerpt: Les civilistes français utilisent la formule " théorie générale du contrat " pour décrire les règles du Code civil ayant vocation à s'appliquer à l'ensemble des contrats. La théorie générale du contrat se présente ainsi comme une très singulière théorie car elle s'identifie à une fraction de l'ordre juridique positif là où toutes les autres théories s'en distinguent peu ou prou. Cette singularité apparente n'est due en réalité qu'à un emploi sans rigueur de la formule et à une confusion extrêmement répandue entre deux notions : le droit commun des contrats et la théorie générale du contrat. Contrairement au droit commun qui rassemble les règles positives applicables à toutes les conventions, la théorie générale est une œuvre de science du droit prenant pour objet d'étude le contrat, et le produit de cette étude. C'est elle qui permet à une partie de la doctrine de dire que c'est la volonté autonome des contractants qui constitue l'essence de l'acte et le fondement de son régime, à une autre que l'autonomie de la volonté est un mythe périmé, à une troisième qu'elle n'a jamais inspiré le droit des contrats. Mais en confondant ces vues sur le droit avec le droit même, la doctrine moderne entretient un mythe : celui de la positivité de la théorie générale du contrat. Ce mythe de la positivité de la théorie générale du contrat ne peut être réduit à un conte, une légende, une histoire fausse. Comme les mythes authentiques, histoires vraies qui expriment un ordre du monde et guident l'action, il est un élément essentiel de la mise en ordre de l'univers des juristes universitaires et une condition fondamentale de leur action. En occultant les apports de la doctrine aux notions et aux principes du contrat, il permet à la science du droit de s'exclure de l'objet qu'elle étudie et de prétendre à l'objectivité. Le mythe de la positivité de la théorie générale évite aussi au " savant-juriste " de se retrouver constamment face à lui-même, de s'interroger en permanence sur ce que son être provoque comme déformations de l'objet qu'il étudie et d'avoir à reconnaître que ce qu'il dit être le droit n'est jamais que ce qu'il pense être le droit.

A l'époque contemporaine, les droits spéciaux de la consommation, de la distribution et de la concurrence, de portée générale, viennent régir la durée et compléter le droit commun au travers de deux grandes tendances : le contrôle de la durée excessive et la tendance à la stabilité du lien contractuel. The chapters identify how traditional legal disciplines (e.g. constitutional law, consumer law, public procurement, international public law), sector-related regulation (e.g. energy, water, waste), and legal rules in specific areas (e.g. eco-labelling and packing) engage with the concept of sustainable consumption. A number of the contributions describe this relationship by isolating a national legal system, while others approach it from the vantage point of legal pluralism, exploring the conflicts and convergences of rules between multiple international treaties (or guidelines) and those between the rules of international and transnational law (or both) vis-à-vis national legal systems. This book outlines the extent to which these new and innovative technologies could have potentially disruptive effects on contract law in Europe. It does so through a comparative, three-part analysis of the recognisability and effects of smart contracts in European legal systems. First of all, in light of the technologies’ transboundary nature, the book employs a comparative approach, considering French law, German law, English law, and Dutch law to analyse the impact on the different systems of contract law. While doing so, it also addresses the formation, interpretation, and vitiation of contracts. Secondly, it analyses the impact of these technologies on European laws regarding unfair terms in consumer contracts and argues that the existing rules should be applied to smart legal agreements in business-to-consumer relations. Lastly, it analyses the current European rules of private international law on the basis of which jurisdiction and applicable law are developed. In this respect, the book concludes that the vast majority of these European rules are “smart contract-proof”.
