  • Release : 2023-04-25
  • ISBN : 9403520639

Download or read book The FIDIC Red Book Contract written by Christopher Seppälä and published by Kluwer Law International B.V.. This book was released on 2023-04-25 with total page 1073 pages. Available in PDF, EPUB and Kindle. Book excerpt: Conditions of Contract for Construction – known universally as the Red Book – published by the International Federation of Consulting Engineers (known by its French acronym FIDIC) is the most widely used standard form of international construction contract. This book is a detailed commentary on the 2022 reprint of the 2017 FIDIC Red Book. For each of the Red Book’s 168 Sub-Clauses the commentary: identifies changes from the 1999 edition; analyses the meaning and significance of the Sub-Clause and lists related Sub-Clauses; describes related international arbitration awards, national court decisions and legal principles; and, where appropriate, proposes amendments to improve the Sub-Clause. As the FIDIC Yellow and Silver Books are very similar to the Red Book, much of the commentary is equally applicable to those forms of contract. The author is a FIDIC ‘insider’ having served for more than thirty years as Legal/Special Adviser to, or Member of, the FIDIC Contracts Committee which is responsible for preparing FIDIC’s contracts. This book is an indispensable resource for all parties called on to work with a FIDIC contract. With guidance for every stage of a construction project, whether in drafting, negotiating, performing, interpreting, or administering a FIDIC contract, the book’s easy-to-use structure includes such issues and topics as the following: introduction to FIDIC and its contracts and to publications of FIDIC and others relevant to the Red Book including the 2022 FIDIC Contracts Guide; critical examination of each Sub-Clause and advice for amending the same in order to better adapt it to the interests of each party (the Employer or the Contractor); special attention to each Sub-Clause relating to the Contractor’s and the Employer’s claims and claims procedure and to how to assert claims effectively, as well as to time bars and other pitfalls and how they may be overcome; detailed examination of Sub-Clauses relating to the referral of issues or disputes to the Dispute Avoidance/Adjudication Board and, if necessary, to international arbitration, and optimal strategies for doing so; discussion of the changes required to the 2017 Red Book by The World Bank’s Conditions of Particular Application (‘COPA’); reference, where appropriate, to the UNIDROIT Principles of International Commercial Contracts and trade usages; comprehensive discussion of practical issues that arise under common law, civil law and international legal principles, especially when a contract is with a state or public body; comparison of common law and civil law methods of contract interpretation and a suggested practical approach to interpretation given a FIDIC contract’s international arbitration clause; and overcoming problems that can arise when a contract is governed by the law of a less-developed country. Legal and technical terms are clearly defined, and numerous figures and tables are included to illustrate steps in contract procedures. Detailed attention is paid to terminological distinctions among the various legal traditions, including a comparison of British-English and American-English construction contract terms. Unquestionably the most detailed and thorough commentary ever published on the FIDIC Red Book, this highly practical work enables preparers of FIDIC contracts to amend and adapt the Red Book’s provisions to a particular project. Dispute adjudicators, arbitrators, and judges will welcome the book’s authoritative guidance on interpreting the provisions of a FIDIC contract, and engineers and other construction professionals involved in contract administration will appreciate the book’s many practical features.

Book Compensating Landowners in the Vicinity of Airports

Download or read book Compensating Landowners in the Vicinity of Airports written by Magdalena Habdas and published by Taylor & Francis. This book was released on 2023-11-22 with total page 246 pages. Available in PDF, EPUB and Kindle. Book excerpt: The purpose of this book is to consider the neighbour conflict arising between airports and neighbouring owners of land, particularly with residential uses, as well as to assess the existing solutions applied to manage or resolve that conflict. The book explains why the neighbour conflict between the airport and landowners is of a particular kind and what legal instruments are applied to address it in an attempt to balance the interests of opposing parties. Readers will develop an understanding of how the law operates when damage is caused by a legal act of the government and what the limits of compensable loss are. In addition, the reader will discover the economic foundations of possible solutions and why not all market losses are legally compensable. Key features of this book include: a consideration of key legal concepts such as neighbour law, nuisance, protection of property, land use restrictions, liability, and compensation to inform a unique analysis of neighbour law in the context of conflict between airports and neighbouring landowners; practical guidance on an airport’s legal liability towards neighbouring landowners; a comparative analysis of airport’s liability, compensation claims, their scope and economic effects; a comparative overview of planning and environmental solutions applied in a variety of jurisdictions; a discussion of valuation methods and challenges when loss of property value is the measure of compensation. The Author’s intention is to promote conscious and civil relations among market participants, as opposed to opportunistic and speculative behaviour. This book is important reading for lawyers, academics, PhD students and postgraduate students dealing with land use regulations, environmental law, compulsory purchase, eminent domain and expropriation issues, compensation for property restrictions, as well as with aviation law and legal aspects of airport operations.

Book Critical Practices in Architecture

Download or read book Critical Practices in Architecture written by Jonathan Bean and published by Cambridge Scholars Publishing. This book was released on 2020-01-06 with total page 422 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book embraces the idea that in today’s complex world, multiple, emerging perspectives are critical to the design fields, the environment, and society. It also brings authors into conversation to focus on the built environment from the perspective of critical practice. The authors take as a starting point Jane Rendell’s ground-breaking work, which defines critical spatial practice as “self-reflective modes of thought that seek to change the world.” In opposition to conventional conceptions of architectural education and work, this book reflects how socially engaged architects, landscape architects, designers, urbanists, and artists take up critical spatial practice. Bridging ideas from multiple countries and approaches to design scholarship, each chapter seeks to find places of convergence for the multiple strands that form around themes of practice, equality, methods, theory, ethics, pedagogy, and representation. Rendell’s foreword and postscript provide context for these themes and suggest a way forward in today’s challenging, changing times.

Book Actualit s et aspects pratiques du droit immobilier

Download or read book Actualit s et aspects pratiques du droit immobilier written by and published by . This book was released on 2019-02-27 with total page 251 pages. Available in PDF, EPUB and Kindle.

Book From Revolution to Chaos in Haiti 1804 2019

Download or read book From Revolution to Chaos in Haiti 1804 2019 written by Rhodner J Orisma and published by Xlibris Corporation. This book was released on 2020-01-13 with total page 253 pages. Available in PDF, EPUB and Kindle. Book excerpt: Haiti is a failing state. The country is still unable to provide basic needs such as employment, food, housing, healthcare and education to a majority of its inhabitants in over two centuries after its revolution and Independence of 1804. Relatively incompetent, both the nation’s government and its opposition ignore moral politics, and instead, focus on corruption and fighting each other. Though free from French rule, the country remains tied to its slave past and violent history. It seems like a socioeconomic and urban consensus cannot be achieved in order to carry out sustainable solutions for the people. This book, From Revolution to Chaos in Haiti, 1804-2019: Urban Problems and Redevelopment Straregies, is an attempt to analyze this situation from a historical perspective. First, the Haitian Revolution of 1804 is displayed to show the violent and bloody struggles of outstanding leaders and warriors against colonial powers for the making of a great political and independent nation. Second, Haiti’s decline is analyzed starting from the assassination of its first leader, Jean-Jacques Dessalines, in 1806 to the country’s bottom rank in the global stratification during the 2010’s along with the impact of the catastrophic 2010 earthquake. The main factors noted within this decline are linguistic, agricultural, urban and (HIV, AIDS, TB) healthcare issues and undercapitalization along with ideological confusions (capitalism, neoliberalism, socialism, social democracy) and political instability.

Available in PDF, EPUB and Kindle.

Book Corporate Social Responsibility in Times of Geopolitical Uncertainty

Download or read book Corporate Social Responsibility in Times of Geopolitical Uncertainty written by Mariia Domina and published by Ethics International Press. This book was released on 2024-08-30 with total page 237 pages. Available in PDF, EPUB and Kindle. Book excerpt: The book discusses the evolving nature of corporate social responsibility in times of geopolitical uncertainty. This uncertainty is prompted by geopolitical risks faced by modern companies, such as the COVID-19 pandemic and climate change, as well as social and economic consequences of wars in Ukraine and elsewhere. Such geopolitical risks undeniably raise questions as to what the new “ethical” norm of corporate conduct should be. This book strives to evaluate the effectiveness of European legal approach regarding the conduct of commercial companies in the times of geopolitical uncertainty. Amongst jurisdictions considered in the book, a particular attention is paid to France. It is one of the leading European countries when it comes to the regulation of corporate conduct vis-à-vis the interests of a large group of stakeholders. As a case study to assess the effectiveness of European legal approach, the book looks at the geopolitical risks provoked by the war in Ukraine. This unique and timely study fills a void in this important area of research by exploring key arguments related to what corporate conduct is, or should be considered as “ethical” in times of geopolitical uncertainty.
