Book The Case Law of the WTO La jurisprudence de l OMC 1999 2

Download or read book The Case Law of the WTO La jurisprudence de l OMC 1999 2 written by Brigitte Stern and published by BRILL. This book was released on 2008-07-31 with total page 645 pages. Available in PDF, EPUB and Kindle. Book excerpt: This unique series offers the reader a comprehensive, bilingual analysis on a case-by-case basis of the jurisprudence of the WTO. Each case study contains: a synopsis and details of the case in question, and important bibliographical references; these are followed by a summary of the facts and procedure, claims of the parties, findings of the panel, issues raised in the appeal, conclusions of the appellate body and scholarly observations. Each case is analyzed by a different scholar in the field, so as to ensure the involvement in the series of the widest range of (English and French speaking) scholars and practitioners. This approach to the case-law gives the reader a complete and objective account of the reasoning of the dispute resolution mechanism, including numerous quotes (in italics when they are extracted from the case in question, for ease of reference), while at the same time offering a critical perspective, which analyses the reasoning adopted and places it in a global perspective. The volumes are organized chronologically, and the cases of a particular year are usually covered in two consecutive volumes.

Download or read book Interlocking Constitutions written by Luis I Gordillo and published by Bloomsbury Publishing. This book was released on 2012-04-25 with total page 263 pages. Available in PDF, EPUB and Kindle. Book excerpt: The existence of interactions between different but overlapping legal systems has always presented challenges to black letter law. This is particularly true of the relationship between international law and domestic law and the relationship between federal law and the laws of individual federation members. Moreover some organisations have created their own supranational constitutional systems: the United Nations Charter is the best known, and is often referred to as the 'World Constitution', but the European Court of Justice in Luxembourg views the European Treaties as a 'Constitutional Charter' for Europe, while the European Court of Human Rights has defined the European Convention on Human Rights as a constitutional instrument of 'European public order'. It is in the dynamic relationship between domestic constitutional laws, EU law, the ECHR and the UN Charter that the most persistent difficulties arise. In this context 'interordinal instability' not only provokes strong academic interest, but also affects what has been called 'governance' or 'global government' and undermines both legal certainty and individual fundamental rights. Different solutions - constitutionalist and pluralist - have been explored, but none of them has received global acceptance. In this book Luis Gordillo analyses the interordinal instabilities which arise at the European level, focusing on three main strands of case law and their implications: Solange, Bosphorus and Kadi. To solve the difficulties caused by this instability Gordillo proposes a form of soft constitutionalism, which he calls 'interordinal constitutionalism', as a means to bring order and stability to global legal governance. The original Spanish thesis on which this book is based was awarded the Nicolás Pérez Serrano Prize by the Centro de Estudios Políticos y Constitucionales, for the best dissertation in constitutional law 2009-2010.

Available in PDF, EPUB and Kindle. Book excerpt: Derived from the renowned multi-volume International Encyclopaedia of Laws, this monograph provides a survey and analysis of the rules concerning intellectual property rights in France. Particular attention is paid throughout to recent developments and trends. The analysis approaches each right in terms of its sources in law and in legislation, and proceeds to such legal issues as subject matter of protection, conditions of protection, ownership, transfer of rights, licences, scope of exclusive rights, limitations, exemptions, duration of protection, infringement, available remedies, and overlapping with other intellectual property rights. The book provides a clear overview of intellectual property legislation and policy, and at the same time offers practical guidance on which sound preliminary decisions may be based. It tries to explain its legal peculiarities, particularly with regard to the concept of internal market. It takes as starting point its liberal roots enshrined in the free movement, competition and autonomy provisions, but focuses equally on the development of countervailing principles about citizenship, adequate standards, and governance. It refers selectively to important secondary law, in particular directives, and to leading cases of the European Court of Justice. It is directed at all law scholars, students, practitioners, political scientists, in the old and new Member countries of the EU as well as third countries who want to understand what EU law is all about. It will allow the reader a first orientation, without suffocating him or her in too much detail.

Book Pharmaceuticals in the Environment

Download or read book Pharmaceuticals in the Environment written by Benoit Roig and published by IWA Publishing. This book was released on 2010-08-14 with total page 221 pages. Available in PDF, EPUB and Kindle. Book excerpt: About 4000 medical compounds are being used in the drugs applied today. It is estimated that worldwide consumption of active compounds amounts to some 100,000 tons or more per year. Consequently, there is a need to highlight the most important questions and issues related to presence of pharmaceuticals in the environment. Pharmaceuticals in the Environment: current knowledge and need assessment to reduce presence and impact brings together results of previous and on-going EU projects with published data from both governmental sources and scientific literature and manufacturers’ data on production and usage of pharmaceuticals. This book puts together the current knowledge and emphasises questions that deserve attention such as: What is the spectrum of most relevant pharmaceutical products (PPs) for the aquatic environment? Which indicators for supporting environmental managers, health authorities? What is the efficiency of urban and industrial sewage treatment plants over a year? What is the fate and behaviour of PPs in sewage treatment plants? If receiving waters are used for potable water supplies, does the presence of these compounds represent a potential hazard to human health? Could we solve some problems by environmental or cleaner technologies? What regulatory approaches, incentives, prevention actions can be implemented in order to lower PPs concentration in the environment? Does a European practical guidance can be developed? Can the impacts of PPs on the environment be reduced through the use of eco-pharmaco-stewardship approaches including the use of clean synthesis, classification and labelling, and better communication of methods of 'good practice'? How can we better monitor the environmental impact of a pharmaceutical once it has received a marketing authorisation?

Book Patent Enforcement Worldwide

    Book Details:
  • Author : Christopher Heath
  • Publisher : Bloomsbury Publishing
  • Release : 2005-02-25
  • ISBN : 1847312551
  • Pages : 528 pages

Download or read book Patent Enforcement Worldwide written by Christopher Heath and published by Bloomsbury Publishing. This book was released on 2005-02-25 with total page 528 pages. Available in PDF, EPUB and Kindle. Book excerpt: Patent infringement procedures are an instrument whereby the patentee defends his protected invention against unlawful use by a third party (the alleged infringer). The difficulty is that the patent is no solid object whose damage can be easily detected; it belongs to that group of rights whose infringement is not easy to determine. The patent is a right described by words, and those words, written into a claim, are so complicated that laymen and lawyers alike fail to understand them. This is the special feature which distinguishes the patent right. This book consists of a series of country reports in which expert patent attorneys describe the patent infringement procedures in their jurisdiction. Since the first edition of this book was published in 2000, developments in the field of patent enforcement have been significant and required a major rewriting of all the seven original contributions (the UK, Germany, France, the Netherlands, Italy, Japan and the US): more than 100 decisions have been added. For the second edition, another eight countries have been included: three from Eastern Europe (Poland, the Czech Republic and Hungary), two from Asia (China and Korea), two from Latin America (Argentina and Brazil), and one from Europe (Switzerland) and there is a new chapter by Dieter Stauder on European issues of patent enforcement: cross-border litigation, cross-border assistance in obtaining evidence, and the new European Enforcement Directive.

Book The Harmonization of Civil and Commercial Law in Europe

This book was released on 2005-10-10 with total page 572 pages. Available in PDF, EPUB and Kindle. Book excerpt: The "Europeanization" of European private law has recently received much scrutiny and attention. Harmonizing European systems of law represents one of the greatest challenges of the 21st century. In effect, it is the adaptation of national laws into a new supra-national law, a process that signifies the beginning of a new age in Europe. This volume seeks to frame the creation of a new European Common Law in the context of recent events in European integration.Engaged in timely and cutting edge research, the authors cast into fine relief the building of a European Common Law. The work is envisioned as a guide and written in a research friendly style that includes text inserts and an extensive bibliography. In particular, this book seeks to orient lawmakers, as well as those individuals interested in EU law, in the intricacies of consumer protection, contractual law, timesharing, and other important aspects in the harmonization of domestic and EU law books. The detailed analysis and research this volume accomplishes is invaluable to those scholars and lawmakers who are the next generation of European leaders.
