Book Family and Familia in Roman Law and Life

Download or read book Family and Familia in Roman Law and Life written by Jane F. Gardner and published by Clarendon Press. This book was released on 1998-05-14 with total page 317 pages. Available in PDF, EPUB and Kindle. Book excerpt: Roman families were infinitely diverse, but the basis of Roman civil law was the familia, a strictly-defined group consisting of a head, paterfamilias, and his descendants in the male line. Recent work on the Roman family mainly ignores the familia, in favour of examining such matters as emotional relationships within families, the practical effects of control by a paterfamilias, and demographic factors producing families which did not fit the familia-pattern. This book investigates the interrelationship between family and familia, especially how families exploited the legal rules for their own ends, and disrupted the familia, by use of emancipation (release from patria potestas) and adoption. It also traces legal responses to the effects of demographic factors, which gave increased importance to maternal connections, and to social, such as the difficulties for ex-slaves in conforming to the familia-pattern. The familia as a legal institution remained virtually unchanged; nevertheless Roman family law underwent substantial changes, to meet the needs and desires of Roman society.

Book Derecho de la familia

Download or read book Derecho de la familia written by Carlos Rogel Vide and published by . This book was released on 2010 with total page 113 pages. Available in PDF, EPUB and Kindle. Download or read book Landmark Cases in Family Law written by Stephen Gilmore and published by Bloomsbury Publishing. This book was released on 2011-07-01 with total page 330 pages. Available in PDF, EPUB and Kindle. Book excerpt: There are a number of important (landmark) cases in the development of Family Law in England and Wales that deserve detailed examination and lend themselves particularly well to historical examination. Family law cases tend to raise highly controversial issues, often on striking facts, frequently provoking wider social debate and/or extensive publicity. Consequently, the landmark cases chosen for this collection provide considerable scope, not only for doctrinal analysis and explanation of the importance and impact of the decisions, but also for in-depth examination of the social or policy developments that influenced them. The stories behind the cases provide a fascinating insight into the complexities of family life and the drama that can be found in the family courts. In recent years, Family Law has seen enormous changes in law's engagement with the notion of 'family', with the enactment, for example, of the Civil Partnership Act 2004, the Gender Recognition Act 2004 and, more recently, the Human Fertilisation and Embryology Act 2008. As we begin to move forward into the new millennium, this is an excellent time to engage in detailed analyses and 'stock-taking' of the landmark decisions, many of which were decided in the 1970s, and which have shaped modern Family Law. This book provides a series of in-depth studies of the key leading cases, and will be of interest to students and lecturers alike.

  • Author : Professor Barbara Stark
  • Publisher : Ashgate Publishing, Ltd.
  • Release : 2013-01-28
  • ISBN : 1409493059
  • Pages : 427 pages

Download or read book International Family Law written by Professor Barbara Stark and published by Ashgate Publishing, Ltd.. This book was released on 2013-01-28 with total page 427 pages. Available in PDF, EPUB and Kindle. Book excerpt: International law has become part of everyday family law practice, as lawyers everywhere are confronted with questions regarding the rights of 'mail-order' brides, the adoption of children from other countries, the abduction of children by foreign parents, and domestic violence victims seeking asylum. Indeed, globalization is transforming family law, even as families themselves are being redefined. This book provides a practical overview of such issues and also examines the ways in which culture shapes family law in different countries. It provides students with a useful introduction to challenging, complicated and fascinating issues in international family law. Finally, by incorporating a comparative perspective, it gives readers an opportunity to re-examine their own legal systems.

Available in PDF, EPUB and Kindle. Book excerpt: Each individual experiences obligations arising from personal relationships. These are often hard to fulfil and give rise to tension between the demands of various relationships, between meeting current or future needs, but also between private norms and the demands of a public set of rules. The international contributors to this volume consider the relationship between family law and family values in the way law is framed, the way we are developing the legal context for new kinds of relationships such as cross-household parenting, same-sex partner relationships, and the obligations of adults to elders, and closes with a plea to rethink family law in terms of the functions we want it to perform. Contributors include Masha Antokolskaia, Benoit Bastard, John Eekelaar, Lisa Glennon, Jacek Kurczewski, Jane Lewis, Carol Smart, Velina Todorova and Jean van Houtte.

Book The Reform of Family Law in Europe

Download or read book The Reform of Family Law in Europe written by A. Chloros and published by Springer Science & Business Media. This book was released on 2013-06-29 with total page 533 pages. Available in PDF, EPUB and Kindle. Book excerpt: In the last few years European Family Law has undergone considerable changes. Although in the past law reform was slow, since 1969 the impetus for reform has gathered momentum. It is no exaggeration to say that the changes that have occurred in Europe in the last six or seven years have radically altered the very concept of the family in Europe. As a distinguished scholar and former editor of the Family Law volume of the International Encyclopaedia of Com parative Law, Professor Max Rheinstein, has put it: 'These transformations are not fully completed anywhere. They have gone farthest in the countries of highest industrialization and in those of socialist rule. But they have set in wherever industrialization has obtained a foothold. The degree of 'modernization' offamily law may indeed be used as an index of a society's degree of Westernization. 'l Yet, such is the force of traditional patterns of thought that, although we are aware of distinct changes in various legal systems, the underlying and implied assumption is that family law can still move within the traditional framework. This is not surprising for, until comparatively recently at least family law was not thought of as a suitable subject of unification. It was claimed that there is a peculiar and distinct element which derives from the mores and innermost beliefs of each people, from a sort of family Volksgeist that renders impossible the approximation or unification of family law.
