Book Draft Gambling Licensing Advertising Bill

Download or read book Draft Gambling Licensing Advertising Bill written by Great Britain: Department for Culture, Media and Sport and published by The Stationery Office. This book was released on 2012-12-03 with total page 32 pages. Available in PDF, EPUB and Kindle. Book excerpt: This year's accountability hearings focused on three areas of particular interest: the arrangements for revalidation of doctors, which are to commence on 3 December 2012, and associated matters such as patient involvement and examination of the language competence of doctors; the professional leadership activity undertaken by the GMC in the last year; and the regulation activity undertaken by the GMC, including the establishment of the Medical Practitioner Tribunal Service. The Council is performing effectively in its two roles of defining and applying standards for the medical profession and providing a focus of professional leadership. The outcome of the Law Commission's consultation on professional regulation in the health and care sector, which proposed a formal role for the Health Committee in the accountability structures, is still awaited. Specific concerns included that whilst there has been some progress on the amendment of domestic legislation which restricts the language testing of doctors this is no substitute for the revision of the European legislation which presently prohibits language testing of doctors on a national basis. There have also been continued upward trends in complaints against doctors received by the GMC, and the Committee expects to examine in 2013 the outcomes of further research the GMC has commissioned into these trends. The Committee feels that the present 15-month target for the GMC to complete 90% of its fitness to practise cases should be lowered to 12 months. The Committee also welcomes proposed legislation to enable the GMC's investigatory arm to appeal against decisions made by the MPTS where the outcome of a hearing is disputed

Book excerpt: Around 80% of online gambling in the UK is conducted with operators which are not licensed here. In December 2012 the Government published a very short draft Gambling (Licensing and Advertising) Bill to require overseas gambling operators to obtain a Gambling Commission licence. The overseas-based remote gambling operators generally opposed the Bill, on the grounds it was unnecessary for consumer protection, might drive consumers to cheaper unlicensed operators and was principally intended to bring overseas operators within the UK's tax regime. Much of the UK-based gambling industry, sports bodies and organisations working to combat problem gambling supported the principle of the Bill. Almost all those who gave oral or written evidence to the Committee raised the issue that the enforcement regime would have to be rigorous in order to provide any of the benefits to consumers. The Committee supports the principle that gambling should be regulated on a ’point of consumption' basis. The Committee also notes the concerns raised about taxation of the online industry. The Government stated that the ability to bring all operators serving UK consumers within the tax net is a consequence, but not the prime motivation, of the draft legislation. The Committee notes in this regard that, in setting a tax rate for remote gambling, the Treasury should bear in mind that too high a rate would be liable to drive customers and companies into the unregulated, black market.

Download or read book Draft Gambling Bill Session written by Great Britain. Parliament. Joint Committee on the Draft Gambling Bill and published by Stationery Office/Tso. This book was released on 2004 with total page 300 pages. Available in PDF, EPUB and Kindle. Book excerpt: This report comments in detail on the draft Gambling Bill which was published in November 2003 as Cm 6014-I (ISBN 0101601425). It is essential that the Gambling Commission has adequate resources to carry out its diverse functions. Spread betting should be subject to regular review every five years or so. Despite its deficiencies, the National Lottery Commission should carry on as the regulator for the National Lottery after the Gambling Commission is set up. The costs of regulation should be borne by those that are regulated and fee levels should be subject to consultation. Premises licensing should ultimately be a matter for licensing authorities, subject to adequate financing, and training. Local authorities should retain the power to prevent proliferation of gambling premises. The research carried out by the Responsibility in Gambling Trust on problem gambling, is commended, and voluntary contributions from the industry to the Trust should be encouraged. Machine gambling by under-18s - and gambling advertisements - should remain under review. The Committee agrees with the proposed 3:1 gaming machine to table ratio in small casinos, but a greater ratio should be considered for larger resort casinos (which should also be required to provide additional leisure and cultural facilities).

Book Modernising Britain s Gambling Laws

Download or read book Modernising Britain s Gambling Laws written by and published by . This book was released on 2003 with total page 82 pages. Available in PDF, EPUB and Kindle. Book excerpt: This Draft Gambling Bill follows on from the Government response (Cm. 5397, A Safe Bet for Success - modernising Britain's gambling law, ISBN 010153972X), which itself was a response to the Gambling Review Body (Cm. 5206, Gambling Review Report, ISBN 010152062X, also known as the Budd Report). Both reports reached the view that the law on gambling was outdated. A major component of the Draft Bill is the establishment of the Gambling Commission, which would act as a regulator, and take over the responsibilities of the Gaming Board. The Bill seeks to regulate the gambling industry through the introduction of a new scheme of licenses and license conditions, carried out by the Commission and local authorities. While local authorities will also have new powers to license gambling premises. The Bill also seeks to maintain three objectives: to prevent gambling being a source of crime; to ensure it is conducted in a fair and open way and to protect children and other vulnerable persons from being harmed or exploited. The document consists of a policy statement, the draft bill, explanatory notes and a regulatory impact assessment.

This book was released on 2012-07-24 with total page 402 pages. Available in PDF, EPUB and Kindle. Book excerpt: High street betting shops and casinos alike are currently allowed a maximum of four B2 (FOBT) gaming machines, which allow stakes up to £100 and a £500 prize. Casinos, should instead be permitted to operate up to twenty B2-type gaming machines. Limiting the number of B2 machines in betting shops has encouraged them to cluster in some high streets in order to satisfy customer demand. Local Authorities should have the power to permit more than the four B2 machines per shop if they believe it will help with clustering. The Committee also recommends that any local authority be able to make the decision as to whether or not they want a casino. As a step towards this, existing 1968 Act Casino licences should be made portable, allowing operators to relocate to any local authority provided that they continue to be constrained by the need to obtain local authority approval, a premises licence and planning permission. The failure to set remote gambling taxation at a level at which online operators could remain within the UK has led to almost every online gambling operator moving offshore whilst most are still able to advertise and operate into the UK. The Committee further recommends the Gambling Commission should introduce a new licence fee structure which reduces the current anomaly where small, independent bookmakers pay much higher fees per shop than large chains. Particularly given the absence of a significant UK-regulated online sector or any Regional Casinos, the Gambling Commission remains an overly expensive, bureaucratic regulator.

Book Regulating Commercial Gambling

Download or read book Regulating Commercial Gambling written by David Miers and published by Oxford University Press, USA. This book was released on 2004 with total page 564 pages. Available in PDF, EPUB and Kindle. Book excerpt: Three quarters of the British population gamble (mainly on the National Lottery), and they generate around 46 billion pounds a year. This volume sets recent developments in the regulation and deregulation of its three primary forms - betting, gaming, and lotteries - against an account of their social and legal history. Many of the concerns that excite controversy today are little different from those with which the Home Office grappled for most of the nineteenth and twentieth centuries. Based upon Home Office files and contemporary accounts, this book begins by evaluating how the law was used to control and suppress popular gambling. Miers shows how and why prohibition gave way to the recognition that regulation offered a more effective method of controlling a social pastime that, by the mid-twentieth century, had become a feature of everyday life. Concerns over gambling have recently resurfaced, as a result of Government proposals to replace the existing strict controls with a regulatory regime that will give greater scope for licensees to adopt more competitive practices. Like the introduction of the National Lottery in 1994, these proposals represent a marked departure from the traditional response: to permit but not to stimulate commercial gambling. The potential for expansion in opportunities to gamble raises concerns about the accessibility of gambling to children and the possibility of increased numbers of problem gamblers. Miers examines the implementation and impact of the present law governing gaming and the National Lottery in terms of regulation and the enforcement of regulatory regimes. He focusses on how these regimes regulate the probity of the supplier, the supply of gambling opportunities, the nature of the transaction, and the player's participation. The book concludes with an evaluation of the Gambling Bill, a draft of which was published in 2003 aiming to give effect to the Government's proposals.
