Book excerpt: Long a major element of classical studies, the examination of the laws of the ancient Romans has gained momentum in recent years as interdisciplinary work in legal studies has spread. Two resulting issues have arisen, on one hand concerning Roman laws as intellectual achievements and historical artifacts, and on the other about how we should consequently conceptualize Roman law. Drawn from a conference convened by the volume's editor at the American Academy in Rome addressing these concerns and others, this volume investigates in detail the Roman law of obligations—a subset of private law—together with its subordinate fields, contracts and delicts (torts). A centuries-old and highly influential discipline, Roman law has traditionally been studied in the context of law schools, rather than humanities faculties. This book opens a window on that world. This volume offers a collection of specialist essays by leading scholars Nikolaus Benke, Cosimo Cascione, Maria Floriana Cursi, Paul du Plessis, Roberto Fiori, Dennis Kehoe, Carla Masi Doria, Ernest Metzger, Federico Procchi, J. Michael Rainer, Salvo Randazzo, and Bernard Stolte, many of whom have not published before in English, as well as opening and concluding chapters by editor Thomas A. J. McGinn.

Book excerpt: Volume 55,2 presents the contributions of the eighth meeting of the Working Group "Legal Documents in Ancient Societies", which was devoted to the topic "Accounts and Bookkeeping in the Ancient World". The volume is dedicated to an early and seemingly ubiquitous type of text, which often followed certain classification criteria and which, for the sake of easier clarity, was gladly subjected to a specially developed layout. In addition to the discussions of individual artefacts or artefact groups as well as literary texts, there are considerations of ancient and modern terminology, the choice of writing media used for this purpose, the bodies entrusted with data collection, the purposes pursued with it, the further processing and archiving of the collected data as well as their organisation at the various levels of administration. The examples from Emar and early Greece again show that a written version was by no means self-evident. The contributions not only draw attention once again to the high level of knowledge that can be gained from such a comparative approach, but also to the great potential of the always underestimated and only seemingly unattractive format of lists and directories. This undoubtedly applies to the entire field of economic administration, but also to questions of military affairs, demography, and sociology, for whose research this serial material is of importance that should not be underestimated.

States are increasingly negotiating agreements that regulate both trade and investment, such as the Trans-Pacific Partnership Agreement and the Transatlantic Trade and Investment Partnership. The number of investor-state dispute settlement cases is growing dramatically each year, yet states' enthusiasm for investor-state arbitration has become more qualified as concern has intensified that the system can be abused by foreign investors. Good faith is therefore becoming increasingly important as a principle, particularly in the investment context, due to disputes about investor conduct such as corporate restructuring in order to gain the protection of a particular investment treaty regarding an existing or foreseeable dispute, and States' responses to public policy concerns through attempts to modify or terminate investment treaties in the face of ongoing or expected claims. Tribunals adjudicating investment disputes have used the principle of good faith in a haphazard and uncoordinated manner, causing serious problems of uncertainty and inconsistency. In response to these developments, this book contains the first comprehensive and integrated analysis of the treatment of good faith in international investment law, noting the broader implications of good faith in public international law and international trade law.
